Hey, 

 

When you submit your AOS/EAD/AP you should apply in your new married name and give your previous maiden name when asked in the forms. USCIS will then update your name to your married name and your NOAs and Biometrics letter will have your new name on them 😚

I would do a little bit of digging on this. You can legally change your surname through marriage, but from what I've read you would need to go to court to legally change your middle name for official docs. Just beware that it may cause issues if you're applying with a middle name that doesn't match your current government IDs (passport, birth cert, drivers license etc). The rules vary a bit state by state on changes too.

12/01/2017 -Went to scheduled biometrics appt
01/09/2018 -Receipt available online: AoS finally updated, EAD/AP still getting "Case number invalid" 

01/09/2018 - AoS is marked ready for interview to be scheduled. waiting for date.

02/02/2018 -Receive Paper approval notices for EAD/AP. Day 94. Receipt numbers FINALLY updated from invalid to approved lol.

02/07/2018 - Receive EAD/AP combo card in the mail. Day 99

30/07/2018 - Received notice of appointment for AoS interview scheduled 9/12

12/9/2018 - Had AoS interview and was approved! Day 320

I would do some research about how to change your name in the State, in my case Florida, the way I did it at least,

1. I applied for a Social Security Card with my maiden name.

2. When I received the card, I was married already, so I went back and changed my name in the Social Security office.

3. When I sent my AOS I filled it with my married name and listed my maiden name.

4. Now that I have my NOA I will go and get my driver's licence or State ID to have a picture ID with my married name.

 

As far as I understand, the way you wrote your name in the AOS application is how it will appear in your green card, yesterday when I went to my biometrics appointment, they kept reminding me to sign with my married name since that's the name I used in my applications.

 

Did you sent your AOS already?

If you did, I believe you can change your name just after you receive your green card

Hello,

 

We were married via K1 on 9/30, still working on AOS, EAD, etc.  Is my wife considered out of status because we haven't filed yet? Is there a timing we need to file by?

 

  • 01/24/17 --- NOA1 date

  • 05/10/17 --- RFE response sent
  • 05/12/17 --- RFE response received
  • 05/24/17 --- NOA2 
  • 06/22/17 --- NVC case number received
  • 06/26/17 --- Package received at RDJ embassy
  • 07/18/17 --- Interview (APPROVED!)
  • 08/05/17 --- Arrival to Minneapolis, MN 
  • 09/30/17 --- Married!

My understanding is that you have to check the date on the stamp next to the K-1 visa on your wife's passport. One should get married and file AOS before that date.

Sorry , totally misread this original post by Emmz! I'd go with what Little leaf said , as I didn't change my middle name! Only my last name to match my husbands!

You have a case in hands don’t worry it will soon be available online. I wouldn’t worry so much since it takes forever to change status anyway.
