It's very frustrating. Have you tried contacting the Ombudsman office? Sometimes it helps.

On August tread, some people when answered their RFE got their EAD after a short time. So, it's hard to tell. When USCIS receive an answer to a RFE, they have 90 days to make a decision. It's really hard to understand why they did not make a decision in your case yet.

Sep 23, 2016 - I-130 - NOA1 

Jun 1, 2017 - I-130 Approval

Jun 5, 2017 - Entered US on L1 - POE and immigration was smooth

Oct 24, 2017 - Receipts for I-485, i-131 and I-765

Jan 31, 2018 - Received EAD and AP

Feb 6, 2018 - AOS interview in SJC

Mar 15, 2018 - Received GC by mail

 

My online case status still stays interview scheduled.

Question  to those that responded a RFE. Did you guys sent a copy of the RFE letter or the original one? In the RFE states that we should send a copy, but searching on internet says that we should send the original.

I sent a copy of the RFE letter as the letter said.

send the original i got RFE in K1 visa before and RFE for AOS the yellow one should be visible

So, they are related.

 

I believe they are asking for 2016 IRS since your husband could not file 2017 yet. My husband is so pissed off because he could not file 2017 either . We are having some problems because I don't have yet my SSN.

 

 

 

 

Thanks for sharing your experience. I just can't believe it took almost 5 months to send me the letter of RFE. I sent the initial evidence that they requested(2016 Tax return and explanation of why I can not submit 2017 tax return) on March 16. We can't file tax return for 2017 until I receive my SSN, so we are filing for extension.
