One more thing- lol, do we have to send an original of the marriage certificate or can be a copy of what the court house sent?

I sent original copies from the court house to show and prove authenticity . You can request extra copies of marriage certificate and keep a copy for your self.

Ok thank you hun, I don’t remember it printing in the paper in the first phase of the process and when I researched I saw ppl used white- out lol ... ok I just signed next to it, added pics. Think everything is ok. Will FINALLY be sending today. My wife and I have been so delinquent with this part of the process.... but I truly hope that I get it sooner than later and wishing the same for all!

Yes I know the feeling ! Thanks , All the best as well

I'd say send in the original and I did the same and you can get a extra copy of marriage certificate for your future records from the same court house for as little as $3 or $5 :)

@Emmz there are two things here:

1. You will have to send a copy of your Passport, K-1 visa & I-94 along with AOS so if you DON'T want to change your name and want to retain your passport name then fill AOS application with the same name as on Passport.

2. If you want to change your surname to your husband's surname (which mostly women do after marriage) then get a State ID or Driving License with the name change and send it along with your AOS application.

You cannot change to your mother's maiden name because am sure that is not the name on your passport. Changing to husband's surname after marriage and getting a ID or License is completely different and easy.

I understand that but since we have to go through immigration and immigration guys want proper documentation and so we can confuse ourselves and the immigration. My suggestion for AOS is go with your Passport Name. Good Luck :)

My wife used Filipino custom of keeping surname (fathers last name) and dropping her middle name (mothers maiden name. Hoping it won't be a problem, but so far no one has said anything, on our marriage certificate we did this also, and her WA state ID. This might be a good question to ask in the Philippines forum.

Also your legal name now is your new married name, so when filing your AOS you should use your legal name not the one on your passport since it has changed.

At what part of the I-485 process will a RFE be possible? I know USCIS website says it can anywhere from first they receive the application to the interview day.

I was wondering if anyone has received an RFE. At what stage in the application they received an RFE? Was it before or after Biometrics?

Also, my NOA in I-485 says received on October 4th and notice date October 11th. No balance due since it is all paid including Biometrics. Year of birth was incorrect so lawyer instructed to call USCIS to correct it and they did a service request. I wonder if they will delay the processing?

The above application/petition has been received by our office and is in process. Please verify your personal information Listed above and immediately notify the USCIS National Customer Service Center at the phone number listed know if there are any changes. Please note that if priority date is printed on this notice, the priority does not reflect earlier retained priority dates.

Next Steps: USCiS will schedule a biometrics appointment for you to have your biometrics electronically captured at a USCIS Application Support Center (ASC). You wi1l be receiving a biometrics appointment notice by mail with the specific date. time, and place where you will have your fingerprints and/or photographs taken. . You must wait to receive your biometrics appointment notice before going to the ASC for biometrics processing. . This notice does not serve as your biometrics appointment notice.

Also, my NOA in I-765 says received on October 4th and notice date October 11th. Eligibility category: C09.

Do RFEs usually happen before or after Biometrics?
