Hey yall, I got married last year to my wife last year and shortly after that we ended up getting a divorce, after which she left and went back to India. A few months after that her conditional green card came in the mail. How do I go about cancelling it ?

K1 Journey

04/22/16....I-129F mailed to Dallas, TX

04/27/16....Delivered at Dallas, TX

04/29/16....USCIS Receive Date (Printed on NOA1)

05/02/16....NOA1 Text & E-mail. Case sent to CSC

05/09/16....NOA1 Hard Copy Received

07/12/16....NOA2 Approval Text & Email received (74 days)

07/16/16....NOA2 Hard Copy Received (4 days from text)

07/28/16....NVC Received Case (16 days from text)

08/01/16....Consulate Received Case

09/30/16....Interview

10/04/16....Visa Received

10/18/16....POE

10/28/16....Wedding

I don't think you can.  It isn't your Green Card.  It is her Green Card.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You can't cancel it (technically abandon LPR status), but she can using the I-407 process linked above.

you don't it is her card only she can cancel it.

 

odds are uscis will consider her to have abandoned her residency if she is out of the us for a year. did she have advanced parole when she left?

In theory, she could return to the US, establish residence, and file ROC with a divorce wavier.....

Never got advanced parole, it was lost in the mail and then the 2 year conditional green card came. At that time it had been quite a lot of time since she had gone back to India
