I-130 Advice and support please :)

Hello

 

My husband and I married in 2016 and he filled the I-130 January 2017 . I am in the UK and we are still awaiting approval. It is currently at Nebraska and its already been a very lengthy and stressful process . The waiting is horrible and I know a lot of you are going through the same. I just wondered if there was any preparation I could do in regards to gather any information ill need for the next steps . I am hoping we hear something back soon its already being 8 months.

The approval should arrive any day now so you can definitely start collecting the documents you need for the next step:

You need a police certificate from the UK and any other country you have lived in as an adult for more than 6 months. You also need the long-form of your birth certificate, your marriage certificate (again, even though you already sent it with the I-130), if either of you has been previously married you also need the divorce decree or death certificate of the spouse to demonstrate that the marriage ended lawfully (either through divorce or death), if you have been to court or prison you need the records for that, if you've been in the military you need your records for that. You also need a copy of the picture page of your passport. If any documents are not in English they will need to be translated.

 

Good luck - it's worth the wait. I went through Nebraska last year and moved here to the US just before Christmas. It WILL happen for you soon!

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

it talks about medical clearance too do I need this and if so how do I get this as, it says you need to go to a certified physician that is recommended  by the USCIS

Also how long after your approval did everything else take ?

and I have my birth certificate its a small one I don't recall having any other one is this the right thing?

Also may o ask when you receive the documents after approval it speak about the financial affidavit my husband needs to do... Do they send them to him as, the way it was written it sounded like I get those forms so I was assuming I would need to send them to him.

After the NVC has completed the review of your documents you will need to make an appointment with Knightsbridge Doctors in London (they are the only doctors in the UK authorised to conduct the medicals for US visas - and, as you can guess from the name, they are not cheap!). You will get instructions about that nearer the time.

 

After the I-130 is approved, it takes about 2 weeks for NVC to receive your file from USCIS Nebraska, and then about 11 weeks for them to review your documents. If there is a document missing or incorrect, you go back to the beginning again and wait another 11 weeks or so. So it's crucial to get all the documents spot on the first time.

 

You need to order a full copy of your birth ceritifcate from GRO http://www.gro.gov.uk/gro/content/certificates/ - the small one about the size of a slice of bread is NOT acceptable by the NVC or embassy. Order the full certificate now from GRO. It takes a few weeks to reach you.

 

After the NVC has finished the review, your interview will be about 6 weeks later in London. About 10 - 14 days before the interview you will need to go to London for the medical. They check for STDs through blood and urine tests, x-ray your chest to check for TB, general checks of blood pressure, pulse, eyesight, ears, listen to your lungs, and then they check that you have had the required vaccines. If you haven't they will give you very expensive vaccines there - try and get them from your GP beforehand if you can.

oh my okay and yes it does sound expensive but I have to do what I have to do ...

thank you . I meant to ask I know my husband has to file financial information in the form of a affidavit of support. The way it read on the timeline for I-130 it sounded like they send the forms to me  after approval .. do I forward this for my husband to complete or will he receive the financial documents ? sorry if I sound silly I just think a lot of it can be a little confusing to get your head around .....

I have just been reading through the NVC time line information and the steps you take once approval has occurred ... so when you say it may take 11 weeks or so to review documents did you mean this is regard to the forms I submit them once I have my case number ? like the agent form, the none immigrant application and the AOs forms ? sorry to ask so many questions ... also did it take long for you to get your case fill number after approval so you could start submitting the other forms from your end ?

Can I ask you a question I'm sorry if this sounds silly. I have read alot of information and just needed to understand...  with the AOS when it's time For my husband to complete this and provide the supporting documentation . Do I then need to get this from him to submit this along with the IV documents to the NVC ? Or can my husband file this form separately to support my IV application ?

Backwards.  Your husband will actually submit copies to NVC, and send the original signed form and copies of the supporting documents to YOU to carry to the interview.

Here's the breakdown of what will happen --

  1. You will hear back from USCIS indicating your application has been approved. This will happen either via text or email (if you've registered for electronic notification on the USCIS website) or you can check the status online at the USCIS Check Case Status webpage. You will also receive a physical paper copy of your cases's approval (called the NOA2). This physical copy will usually come ~2 weeks after electronic notification.
  2. 2 weeks after approval USCIS will mail your application to the NVC. Your case status may update from "Approved" to "Mailed to the NVC"; this may not always happen. You can call the NVC as often as you'd like to check if they've received your application and if they've assigned a case ID. You can also ask for your customer invoice number at this time. At this time, you should also give them your email address, so all future communication with the NVC will happen electronically.
  3. 1 week after the NVC receives your case and scans it into their system, you should receive a welcome letter via email. This letter will contain your case ID and customer invoice number.
  4. Using your case ID and customer invoice number, you will (1) choose an agent (i.e., who should receive communication regarding this case), (2) pay the IV and AOS fees, and (3) fill out and submit the DS-260 form. You will need to do these things in the order listed; there maybe upwards of 1-2 weeks you will have to wait for these things to "open up" on the website.
  5. At this point, you will assemble two different packets -- the IV packet (containing your civil documents) and the AOS packet (containing your husbands financial forms; you have to download the I-864 form yourself).
  6. You should mail these two packets TOGETHER. Typically, the advice on VisaJourney is to assemble each packet and stick it in its own envelope. On each envelope label it as IV or AOS, along with your name and case ID. You should then stick both envelopes in a third envelope and mail BOTH packets together.
  7. Call the NVC as often as you'd like to see if they received your submission and when it was SCANNED into their system. This is your scan date.
  8. 11 weeks after you scan date, you can begin calling the NVC again to check to see if you case has been approved.

No. The 11 weeks is after they RECEIVE all your documents. After your so-called SCAN date. Filling out an agent form and paying the various fees is time ON top of the 11 weeks.

Hello Thank you so much that was very useful :) the only thing I just want to clarify is about the AOS 1-864 that I need to download ... do I fill this in myself and submit it with the evidence my husband sends me or does my husband have to do this then send it to me so I can mail it along with the IV package  ?
