Hi All, I just reveived a I-797 Notice of Action in the mail for an approval for my Adjustment of Status application.

 

This is really exciting news but also very confusing. I applied for Employment Authorization at the same time as my adjustment of status (as is common) and I've heard those usually take less time to get approved than adjustment of status. I also expected an interview date instead of just an approval. So I'm not really sure what to make of this. Can anybody shed some light on this for me?

 

Here are my immigration details:

Visa Type: K1

Date of Entry to USA: April 12th 2017

Marriage Date: May 6th 2017

I495 filed: Mid July 2017

NOA1's Received for I485 and I764: July 31st 2017

Biometrics Appointment: 25th August 2017

 

Since then I have been waiting for my employment authorization to come back, and expected it sometime in the next few weeks.

 

I have also attached a picture of the notice I got today.

K-1s often don't get interviews since they were already interviewed recently at the US embassy overseas. It seems to be a 50-50 chance to have the interview waived for a K-1 person.

 

The EAD and AP are only to use when you wait for your greencard to be approved. And yours has already been approved so there's no need for the EAD/AP anymore, USCIS will cancel those two applications.

K1's aren't in a category affected by the change.

"Effective Oct. 1, USCIS will begin to phase-in interviews for the following:
 • Adjustment of status applications based on employment (Form I-485, Application to Register Permanent Residence or Adjust Status).
 • Refugee/asylee relative petitions (Form I-730, Refugee/Asylee Relative Petition) for beneficiaries who are in the United States and are petitioning to join a principal asylee/refugee applicant."

 

As mentioned there has already been a very recent interview by a CO at the foreign consulate for K1's - which is in line with an immigrant visa interview and not a non-immigrant visa interview as far as the scope and requirements. That is still the case, and will allow K1's (so far) to still be considered for interview waivers as previously.

Oh sweet. The articles I previously read were vague and didn't mention the k1. Good to know!

Congratulations! We are also Early July AOS filers from K1.

 

More and more July filers are hearing news back. Fingers crossed my husband gets his EAD/AP approved or GC would be awesome soon!

 

We are both anxiously awaiting for him to join the work force here but for now him and our dog are really bonding at home (I jokingly call him the stay at home dog father).
