My fiance is a Bahamian! He has a tourist visa bit expiring for 10yrs! We are trying to figure out our best options. Because he has children he will need to travel back and forth! Will us getting married be better then applying for a k1! I believe with the k1 upon arrival he cant travel or work b4 Aos! With spouse he can obtain greencard and traveling sooner! Whats your suggestions!

After applying for AOS and concurrently applying for AP and EAD he’ll be able to travel even with a pending AOS about 3 months after his application is accepted, he won’t have a green card by then but he can travel with AP.

06/24/2017 - Notice of action (Acceptance letter) received in the mail.

06/30/2017 - Biometrics appointment received in mail.

07/03/2017 - Biometrics done! (it was a successful walk in, my appointment was 07/10)

09/02/2017 - Service Request for EAD.

09/25/2017 - Call to tier 2 after no update on SR.

09/25/2017 - New Card Is Being Produced!!! (YAY)

09/30/2017 - EAD in hands!!!

04/08/2018 - Online Status Changed! - Interview Scheduled!!!

04/11/2018 - Inteview letter on the mail!

05/11/2018 - Interview at West Palm Beach field Office - Approved on spot!!!

The only way to avoid at least a three month (after marriage AND filing AOS) lack of freedom to travel internationally. is to take the spouse visa route.  To be clear, nothing prevents the K1 visa holder from LEAVING the USA at any time.  The issue is getting back in.

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Given the circumstances I would focus on the CR1.  You can get married anywhere, even in the US assuming he can show strong ties that he does not intend to stay after the wedding (I.e he will leave while the CR1 is being processed).  His visitor visa will stay active while the CR1 is working its way through the system, so he should still be able to visit again as long as he can prove to CBP that he does not intend to stay when he enters.
