My case is almost the same ,my fiance is in US and am in Nigeria,we have been dating for 2 years and have been to Embassy twice on B1/B2 visa which I was denied.

But now she is playing to come down to Nigeria so we can go to court for marriage, so I can apply for K3 while she apply for I-130 when she get back.

I want to ask on this point, is it going to work out with this process?

Very unlikely, but not totally impossible.

If you get married in Nigeria have your wife bring back the original marriage certificate and have 2 certified copies made their in Nigeria also. Have your wife take the original marriage certificate and 1 certified copy with her and you keep the other certified copy with you. When your wife comes back to United States have her file 1-130. K3 is rarely used anymore but the CR/1 is.. Check out this website which way best to file..

Does that means the K-3 visa is no longer active but CR1?

K3 are very rarely granted.  Don't waste your time.  Just stick with the CR1 route and don't send the I-129F.
