Hi, I hope u guys can give me some advise about this....

 

first you might need to know about me little bit.

So let me introduce myself

I am here in U.S without visa right now(DA is not visa status i assume). 

I am trying to join or joined US army

(Long story short, I sign the contract with them but my background check on-going for 2 years. my visa expired so they make me to apply DA. i am OK to stay in america until 2019).

 

 

I recently submitted I-765 for Employment Authorization Document (A.K.A, EAD).

According to Letter from the Army; The FutureSoldier will also need to request EAD to enable him/her to support themselves while on hold.

 

When i submitted the form, I did not have filing fee.

I request fee waiver(I-912), instead of sending the filing fee

 

 

These are the Docs that I submitted

 

I-765 
I-765 WS  
I-912  
DA letter from USCIS 
copy of SSN 
Letter from US Army ( about applying DA and request employment authorization) 

 

but it did not work out

 

So, they sent me back all of my document with green slip says "when you resubmit your application, please enclose this letter with your re-submission."

and I-797 reject notice; the letter said I needed to put the right amount of filing fee, or provide evidence that my income lower than federal income something like that.

 

but I was with a student visa(can not work in USA), never worked in USA or other country before. no income, no tax to report. basically, not a single official document showing that I don't have income, either i do have. but as evidence, that is what they wanted.

 

so i borrow some money from my friends n make 495$ (410$ filing + 85$ Bio)

Re-send it with all the documents(same Docs from the last time),  green slip with I-797 and 495$ money order few weeks ago.

 

 

and I got an answer today by mail.

it was another I-797

 and this time they sent me back the money order.......

 

 

this is how it look like

so i do not understand.

 

First one says i need to enclose correct amount of fee. (i did)

and now what they want me to do?

Why they just return my money order that i sent

what should i do in order to get EAD

You must’ve sent in the wrong fees. Your filing fee should be $410

You must also pay an $85 biometric services fee, for a total of $495, ONLY if you are filing with one of the following eligibility categories: 

(c)(33) Requesting consideration of Deferred Action for Childhood Arrivals (DACA);

(c)(35) A beneficiary of an approved employment-based immigrant petition and you are facing compelling circumstances; or

(c)(36) A spouse or unmarried dependent child of a beneficiary of an employment-based immigrant petition who is facing compelling circumstances. 

So send the application back again together with a new money order for $410, as well as the green slip enclosed. Now with regards to you joining the military, you’ll need to be a lawful permanent resident to be eligible. The MAVNI program was the one that allowed temporary lawful non immigrants to join with vital skills such as language and is currently closed. A parolee (D/A) “status” isn’t a status for military enlistment.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

3/12/2015: Green card mailed.

3/14/2015: Green card delivered.

Removal of Conditions: 

12/14/2016: Mailed I-751.

12/19/2016: NOA issued.

01/26/2017: Biometrics.

05/03/2018: I-751 transfered to NBC.

02/27/2019: Joint I-751/N-400 Interview.

05/14/2019: I-751 APPROVED.

Naturalization:

12/02/2017: Mailed N 400 to Phoenix, AZ Lockbox. (I-751 still pending)

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

06/12/2019: Swearing in Ceremony! Finally a U.S. citizen!

$495 is correct amount.

 

and About the military, I swear in 2015 June.(original shipping was DEC 2015)

but i could not ship out because of unfinished background checking.....

End of 2016, US army requested to Future Soldiers to keep the legal status, or request Deferred Action

I would suggest you call USCIS and speak with a Tier 2 officer and find out what is going on. It might be that your request for waiver was later approved and you don't need to pay for it anymore. The only sure way is either you go to an infopass or you call a Tier 2 officer.

Thanks for your info i will definitely check it out tier 2 office for it
