Today we got our RFE letter "requesting additional evidence"  in the mail and it is slightly confusing us...


They are requesting a photocopy of the front and back of our marriage certificate.....we submitted an original marriage certificate already..

They want proof of a bona fide marriage:
-joint bank account, shared insurance, bills in both names, property deeds
We did not originally send any of this because we thought it would be brought to an interview..

We originally did not send in 2016 tax transcript (sent in 2015, 2014, 2013) because it had not been filed yet, so we thought that this RFE would be about that...
Should we send in the 2016 transcript even though it was not on the list?

Timeline

I would go ahead and send it in. We got an RFIE when we didn't submit our 2016 tax return even though it was January when we submitted it and it was too early to do taxes <_< In regards to the marriage certificate, sometimes the USCIS loses stuff, as infuriating as it is :/ Unfortunately we have to play by their rules and have to make up for their mistakes. Send the evidence that you have and just bring it for the interview as well! :)

07/25/16-NVC Case Number Assigned.

07/26/16-Case was in Transit.

07/28/16-Case is now 'Ready' in Amsterdam

08/03/16-Received packet 3

09/27/16-Interview - APPROVED!!

09/29/16- Visa received.

10/29/16- POE date.

12/03/16-Receiving Social Security Number

12/01/16-Married

 

01/09/17-Filed AP, AOS and EAD

01/22/17-Received NOA1 

02/06/17-Biometrics Appointment Letter Received 

02/10/17- Digital RFIE received 

02/16/17-Biometrics appointment

02/21/17-RFIE Response Sent

02/23/17-RFIE Response received by USCIS

02/24/17-Status was updated on the USCIS website to "Response received" 

03/09/17-Status changed to "Ready to Schedule Interview"

04/14/17-Filed a service request for EAD card

04/19/17- EAD card is being produced

04/25/17-EAD/AP card was sent out.

04/27/17-Received combo card. 

09/25/17-AOS Interview-APPROVED!

09/30/17-Green card in hand! Done for 2 years :D

It's not the first time I see that someone gets an RFE after sending a certified copy of the marriage certificate. Not only should you never send originals or certified copies unless asked for it, it almost seems as if they actually prefer photocopies which is kind of funny. Sorry that you got an RFE for that.

Them asking for proof of bonafide relationship probably means that they are about to waive your interview, so when sending you an RFE anyway they ask for a little extra to make it easier for them to make a decision without interviewing you (it's a 50-50 chance to get an interview when you arrive on a K-1).

Yes, add the 2016 taxes, that is also good proof of bonafide relationship as you filed together as married.

Yeah, now looking back we agree that a copy would have been a better option (but as we had an extra one we sent it). Oh, well! 

We are leaning toward sending in the 2016 tax transcripts, but they are of our co-sponsor and not us. I don't think that adds much of a difference though.

We figured they lost it or just want a copy since they ask for a copy, haha. (pretty much our mistake, even though some people send in originals and it is okay).

I think we will send in the tax returns because they ask for most recent year. I (the wife) seem to still overthink everything!
