Hi,

I recently got married to a US citizen, I came to the US in a K-1 visa, I haven't adjust my status yet, because I was wondering if I can include my son who is not in the U.S. in my adjustment of status (I-485) or should I request a K2 visa for him? I don't know how to proceed.

Well your child has to come to the USA first. Hence, he needs a visa. You can do aos for him when he's away.

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview.

AoS

03.2015 - AoS started.

09.2015 - Green Card received.

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

he needs to be here since the adjustment of status is a separate petition for him

your husband will file for him as his stepchild, so he won't adjust under your petition

if it's been less than a year since your k1 was approved and he was listed under your k1 as k2, he can have his interview and come and then your husband will file a separate adjustment of status packet as his stepchild
