My mother's 1-94 will expire on November 05, 2017, she has 10 year multiple entry tourist visa. I recently received my US citizenship thru naturalization. I would like to petition my mother, can I apply I-130 and I-485 while she is still here? Is it legal for her to stay here while the application is being processed? 

 

Any information, experience or advice is very much appreciated.

Thank you so much Carmela, she only have 1 month left before her I-94 expires, do u think I have enough time?
