Divorce decree dilemma

I am not sure that anyone came across a similar issue, but I will try asking :) In Russia there is a Divorce Decree from the court, and a Divorce Certificate (Svidetel'stvo o razvode) from ZAGS - these are two different documents. I have a dual citizenship - US and Russian, and I had a divorce in Russia in 2005 (I was a US permanent resident back that time, and my wife was residing in Russia - the relationship did not work out, so she divorced me). I have the original final divorce decree from the Russian court, but no Divorce Certificate from ZAGS. I am applying for K1 visa for my Russian fiance now. Do you know if they will ask my fiance for my Divorce Decree or Divorce Certificate at the Consulate during her interview? Apparently in Russia the Divorce decree in not the only document you need to have to prove your divorce. You also need to have a Divorce certificate, which I do not have. Did anyone have a similar experience?

Hey,

I was in this situation 2 years ago. I think you need certificate of divorce... The one reason for this is that the document must have an Apostile (international recognition) on it. ZAGS would only stamp with Apostil the Certificate of Divorce.

More importantly, you'll need a proof of divorce long before the interview 'cause you need it to file for I-129.

when and if it reaches the consulate a big AZZ denial will be on the paper.

that will have to be addressed later on in the process. all that wait time wasted, only to start over.

dont make matters worse for yourself. do this stuff the right way - the first time.

handle your business!

For her K1, my wife used the documents she got from ZAGS for her divorces. We'll do it that way again.

I take it that it isn't possible for you to go to the appropriate ZAGS between now and her K1 interview?

1-30-2009 AOS interview
2-12-2009 10-yr Green Card arrives in mail

2-11-2014 US Citizenship ceremony

Certified copies of these documents may be obtained by applying to the Bureau of Acts of Civil Status (ZAGS) of the locality having custody of the records.
