Permanent resident petitions are being processed ahead of USC's at Texas Service Center?

My partner and I submitted our i130 forms to the USCIS in July 2017, which made their way to the TSC. We're anxiously awaiting our NOA2. We currently live ~9,000 miles apart, so seeing each other frequently is very difficult, especially since we're both working professionals and have only a limited number of vacation days. 

 

I occasionally visit the USCIS site to check on the processing dates of the i130 applications. As of today, the TSC is processing USC filings as of Dec. 2016 and permanent resident filings as of Mar. 2017. Is it just me or is this highly unfair. Why would permanent residents be given priority over USC? To have to deal with this unfairness, on top of what is already a very frustrating process, really pushes me over the edge.

Two items...

  1. The dates there aren't necessarily representative of what they're currently working on. There's a lot more USCs filing got a spouse than LPRs, so there's a higher likelihood of having some that take longer. It doesn't mean that's the latest case they are working on.
  2. LPRs have to wait for an immigrant visa number to become available based on their PD. For a spouse, it's about 18 months before NVC will start processing the case. Barring very extended delays, your case will get a visa long before they will since you have no wait (only processing times).

To clarify on @geowrian 's point 2.  For the spouse of a USC a visa is ALWAYS available. So after the USCIS processing it goes on to NVC processing. That's where it is different. After USCIS processing (which is what they do at the Texas service center) the permanent resident's case will just sit and wait until a their priority date becomes current and they can move on. ( As mentioned this is right now about 18 months.)

 

You are not the first USC to ask this question here. It's easy to start seeing ghosts that don't exist when the frustration over the process is so great.

Don;t worry! I am USC that filed for I-130 for my husband PD of 01/20/2017 at Texas Service Center and we received our approval on 07/20/2017. So you should get your approval a lot sooner than you think. They should be working on I believe March 2017 or April 2017 as of now. Look forward to an approval in early 2018. Hope this helps!

By the way, if you would fill in your immigration timeline, you could help others later on! Anyway, stay happy and strong - my timeline estimates a response by mid-January. I hope this helps.

 

Plus, what you can do before the crazy christmas period starts, is to collect all the documents and information needed for the NVC stage and update your shots.
