Will new policy change on marriage AOS affect current cases?

Timeline

We have our Green Card interview on Monday and I was wondering if anyone knows if this policy change (below) affects current cases. We got married around two/three weeks after I arrived on ESTA visa and my wife petitioned for my AOS around 80 days after I arrived.

Please see my timeline below.

 

JUNE 15 2017 : Everything was received by USCIS

JUNE 23 2017 : Received BIO appointment

JULY 13 2017  : Attended BIO appointment

JULY 13 2017 : Received Request for initial evidence for 1-130A (Dated July 07) / Yellow paper

AUGUST 09 2017  : Response to USCIS request for evidence was received.  Our national benefits center will begin working on your case again (From CaseTracker app - did not receive notice in mail)

AUGUST 14 2017 : Received a purple letter saying that :

        The version of the form I-693 is no longer in use....... >>

  • if you receive an interview notice please bring the updated I-693 with you
  • If your case don't require an interview you will receive an RFE

AUGUST 23 2017 : Online Case status changed to "Case is ready to be scheduled for interview 

August 29 interview scheduled for October 2nd

September 27 - EAD: New Card is being produced.

Timeline

USCIS has not implemented that policy change. That article is about the state department and affect people who decide to go the consular route. It has always been on the books in some form but the current government seems to be tightening it up.

Awesome, thanks for the reply. 

 

So it won’t affect me because my visa was waived? What do you mean consular route - would it not be the same for all people that come in on one visa and then try to adjust? Just curious!

The rule has been adopted by the Department of State (DOS). DOS is the department that is responsible for embassies/consulates & issues visas.

AOS does not involve a visa and is handled by USCIS, which is under the Department of Homeland Security (DHS). Thus far, USCIS has not adopted the same rule.

Whether you came in on VWP or via a traditional visa isn't a factor here.

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

8/15/2017: POE
