NVC Expedite Request

I want some help and suggestion from group regarding expediting my case at NVC, below are details of my case:-

  • 27/03/2017 - My I-130 petition was approved  by USCIS, but still not reached NVC
  • 20/09/2017 - I requested USCIS to EXPEDITIOUSLY send approved petition to NVC, USCIS investigated and sent approval notice to NVC on 28/09/2017.
  • Since it's an error committed by USCIS by not sending my approval notice to NVC for six months
  • I am planning to make expedite request to NVC as it's a clear error committed by USCIS
  • This delay has also caused me financial hard ship as my daughter is in USA and I am forced to maintain two houses.
  • I want some guidance from this group weather the grounds mentioned above are enough for NVC to grant me an expedite or should I also mention something to get my request approved.

I guess you have strong enough reason to ask for expedite your case after submitting forms and fee. you can simply give above mention reasons and i believe it will be enough.

Good luck

How is this a hardship to the petitioner?  From what you've written, you are the beneficiary.

Petitioner is my daughter, she is a US citizen and I am beneficiary (Father)

It's not hardship for petitioner, but it's hardship for beneficiary because as a father I have to maintain two house as my daughter is currently not working but studying in US, and I have to financial support her from India. I hope it's clear now.

I think it's unlikely it will be approved.  No financial hardship to the US citizen and likely nothing new for the beneficiary -- i assume you have been supporting you daughter for years, as it is your responsibility as her father.  Also, it's not NVC's fault that USCIS (a completely different federal agency) messed up, so they likely will not expedite based on that -- they would not have any information as to whether there was some legitimate reason for the delay.

Could your daughter get a job?

I don't think USCIS cares if it is a hardship on you as you are not a US Citizen or green card holder.

Wow!! My Expedite request approved By NVC and US Consulate in India and my file is way to US embassy
