HI All,

My fiancé and I are hoping, assuming all goes well from this point on, that he will be in the country sometime between November and late January (we got an RFE a week ago but I sent it right back and got an email two days later saying it'd been received). 

He and I will get married here once he arrives, obviously, but we were hoping to travel and maybe even have a wedding party in Spain next summer and/or at Christmas. 

Therefore, does anyone know the approximate duration of time it's taking for Spanish citizens to get AOS once marriage has taken place and the application has been submitted?

Also, we have heard various things about the likelihood of his being able to travel. One Peruvian friend who just got her permanent green card and has been here for years said he'd have no problems getting Advance Parole. Another British friend said it's very likely he WON"T get AP since he's never lived here before. 

I'm mostly just wondering whether we'll be able to plan any international trips after he arrives. We both love to travel!

K1 visa is one time visa, when you submit the AOS forms, including the EAD and AP (since those forms are free).

 

I have been reading AP has been longer to gey approved these days but processing time is about 90ish days after submittance.

 

If your fiance goes outside US after marriage and before AP, you will have to start over a CR1 visa.

9/19/2018 EAD/AP approved

9/20/2018 EAD/AP card in production 

9/24/2018 EAD/AP card is ready to be mailed

9/25/2018 EAD/AP card is mailed, usps tracking included in online update

9/27/2018 EAD/AP card picked up at post office

 

I-130 for 2 husband's daughters (my step daughters) 10 and 17

Yes, I"m aware we can't leave the country until he has AP. But I've also heard he might not get AP and that AOS can take months...so I guess that's what I'm asking. Are most people granted AP while they wait for their AOS
And yes, we're aware that K1 is a one-time visa!

Sorry, i was thinking Christmas 2017. 

 

AP/EAD right now is about 90+ days, so, after your husband gets his AP, he can travel.

 

So, he should be good by Christmas 2018.

I've never read anything here about denied AP/EAD. Especially if youre not going for the emergency AP.

As long as you meet the qualifications for AOS and the I-485 + I-131 + supporting documents are filed properly, there shouldn't be any reason for AP to be denied.
