Legal Permanent Resident sending for children abroad

Timeline

If my fiance in Jamaica decided to wait and bring his two boys due to me having children already and not being able to meet the financial requirements, can he "send for them" at a later date?  What would they process be? Once we are married and he's working can he go through the k2 visa process for his children or would it be something else? What should we do?? Any suggestions??

Timeline

If he won't be able to bring them the same time as he goes then he can do K-2 within one year of getting his K-1 visa issued.

 

If that can still not happen then you can petition for them as stepparent but it will take a bit longer.

Thanks! What if both children were not on the K1visa petition?? Should we suspend it to add the younger child or can my fiancé still do k2 visa for the child not on the application??

Children always have to be listet on the I-129F no matter if they are coming or not. 

 

If you haven't mentioned them then it can create problems later on when he want to apply for them.

He just got sole custody of them and wasn't certain if baby was his son...I read something about the consulate suspending the petition if you add a child....so I'm wondering should I just do so now although we haven't even received NOA2 yet. He wanted to get married, work then send for them, like add them under k2 visa (you have a yr to do so?) but I'm not sure if it works like that?

He can't ask for K-2 visas for them if the were never mentioned on the form.

 

Some countries are fine with sole custody but others still want to see a notarized letter from the other parent stating they can be taken out of country and to the USA to live permanently.

Does anyone know what to do if a child was not on the k1 visa petition if they can be added or the parent try to bring the child later?  How do you suspend your petition to add a child to bring at a later time and approximately how long would that delay the process??   (Do you simply wait until the consulate interview and inform them of the mistake??) Does anyone have any such experience?? Please reply! Thanks.

Has it been 1 year since the K1 was granted or is the beneficiary still in process? Why was the child not mentioned on the I-129F?

The i-129f asks about the beneficiary's children. If they were listed, they can get a visa, they can follow up to 1 year after the K1 is granted. If not, then an i-130 has to be done for the child.

Cateogory: CR1

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

Thanks but Will doing another I-130 delay the process significantly? Can another relative simply petition for the child to come later?? Can he petition for the child once he has established LPR??

Well he was going through court and u sure about paternity but now it has been established and he has sole custody...everything is still in process he has not even had an interview...was wondering should he tell the consulate during the interview or should I suspend the petition or simply wait until he has LPR and does the process for the child later on his own

Fastest is to go for the k2. He should do a ds-160 and medical, and book interview for the child.  Will need another i-134 for the child as well.  2nd fastest is for the USC to petition the stepchild.  Slowest process is the LPR to petition their child.  AOS is taking about a year or so.. that means a 3 year wait for the child.
