Ex and his foreign spouse

To refresh, these were the questions of the OP

 

1)  Does he have to live here in US to sponsor his wife to the US? - How is this relevant to her getting her owed support?

 

2)  If he moves here, he would voluntarily give up his job overseas to make less money and this should not change the amount of the support he pays BUT, does immigration factor his financial obligations in determining financial support for his wife or just gross income? - If it shouldn't change how much he pays, then why does it matter what immigration factors in to support his new wife?

 

3)  He has been becoming hit and miss on paying the support payments as they have been traveling around the world quite a lot.  I'm pursuing contempt of court because of him non-payment.  If he is charged with contempt of court, will that impede the immigration process in any way? - the first part is the only thing that is relevant to the OP, why ask if it will impede the immigration process? Shouldn't the question be "how can I get my owed money if he is over-seas"? If that is what the OP is worried about.

he may be under the tax threshold but still needs to show he filed and make out the appropiate forms for exemption (over 100,000)

That all depends on how long they were married and what state they are in.
