Someone has asked me this and not really sure how to answer.

 

Her soon to be husband (they have not meet yet) is in Ghana and had a Traditional marriage and had 3 children. Now she (The US Citizen) wants to marry but how with a traditional marriage that shows no marriage certificate.

Is there a way in Ghana to get a traditional written dissolution so she can eventually file a petition? They plan to marry when she makes her first visit soon.

I advised you don't dare say he never married when they have 3 kids and the mo has his last name, thats a misrep ban waiting to happen.
 

Well anyone been through this. Please advise.

If he was "married" in any way at all, she should take NO action toward a visa until that marriage is officially dissolved!!  Ghana is considered to be a high fraud country, and immigrant visas are very difficult to get even without any red flags........

Marrying on the first visit-  BAD mistake!!!!

Please advise her that SHE needs to come to this site and search for Ghana marriages before she goes!!!!  There are plenty of experiences which will give her a good idea of the difficulty she faces.  I'm not saying she shouldn't marry.....I'm saying  "BE PREPARED" because she is going to need an EXTREMELY strong case if she expects to successfully obtain a CR-1 visa for him........marrying on the first visit will make it more difficult in my opinion.

 

EDIT:  and both must always be completely honest regarding immigration.  Otherwise, they could be in store for years with no visa.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Correct. Lady, take your time, he needs to divorce the previous marriage and it's up to him to ask how to do and do it, not you, an American citizen who doesn't know well their traditions.

I also would say file after his divorce the K1 visa, it will give you time to see him in real living together and decide to marry or not

ah, and also watch out if he decides to bring his kids with him, if he does, it's very possible the mother of his kids will try to come on tourist visa at the same time with him and kids or a little later even being divorced and wait for him to divorce you, in the mean time you will have a marriage a trois
