so the consulate called my husband today at 4:45.......

his visa was denied pending release from the military. the guy who interviewed him didnt know it was a rule until it was pointed out to him by his boss today.......he called, very apologetic. once the final discharge papers are issued he has to send them to the consulate so they can issue the visa. catch 22 ......dont quit your job until you are issued a visa .......cant issue the visa til u quit your job.it's not their fault , rules are rules but grrrrrrr

so here we are with yet another thing the f@#king Canadian Forces have fkd up. His medical release was supposed to have been completed back in February but per the norm there is always an excuse for someone not doing their job. At this point no one even knows where his file is. he could release voluntarily and be out in 30 days....but ......the medical release is worth an additional $38,000.00 of pension income over 2 years...... so we wait. I cant even guess how many times ive said screw the 38 grand and come home.

so now im adding the days this delay will add to getting him home.......looks like i'll be in Canada for our anniversary.

WOW, that is crazy!! I was still in the Cdn Air Force when I got the visa, and was actually stil in the military (on paid leave) when I activated it.

I know releases for medical reasons are a pain. I belive the medical board only sits so often each times a yr!! Hope it gets settled very soon.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

Either DOS changed it's policy on this or you got lucky and it was overlooked.......either way , you got lucky :)

Supposedly DMED POL has ruled on it and it was sent to DMED CARM but of course no one there has a clue where it is. He already signed his waiver. His CO hasn't heard from anyone and his case worker was supposed to have contacted DMED CARM this week but dontcha know today the base was on stand down.....nice weather ffs. So again we wait til Monday to get any answers. I told him to turn every rock and do not stop until he has an answer from SOMEONE......padre.....whatever. He needs to see the padre and inform him that his wife is on the verge of a psychotic episode if this isnt wrapped up soon. The entire notion of the CF's commitment to family has become a fkn joke. 2 years ago my husband requested a transfer to Borden to be near his mother and sister ( Barrie)who was suffering with cancer. His mom is widowed and his sister a single mother of 2....they needed him there. His request was denied because apparently mothers and sisters dont meet the criteria for "immediate family". Now he's requested expedited handling of his release because he's already pensionable, has no desire to stay in, wife in the states etc....that was back in October. Since his sisters death he has again requested they move the file quickly so he can be free to be available to his family both in the states and Canada. That was 6 weeks ago......what a joke.

Wow... I read the Topic Head and I was like... oh no.. not something else and I was not sure when you said denied pending release since I thought your ordeal was finally over. Hope this gets resolved soon.

I have yet to come accross a govt institution (Canada and US) that give priority to Family issues. I mean its not like their lives are being affected by all of this and I cannot understand how these people can distance themselves from issues relating to family and not care.

Oct 1/09 - I-751 package sent

Oct 3 - package delivered

Oct 5 - NOA mailed

Oct 13 - 1st NOA received and additional letters for my daughters I filed with. NOAs stated Resident Status

has been extended for 1 year and that we will be receiving a letter for an ASC appointment for

fingerprints, photo, and signature.

Dec 2009 - Received 10 year permanent resident card.

Feb 2010 - My children received their 10 year permanent resident cards.

Oct 2010 - My children were legally adopted by my USA Citizen husband.
