I'm saying that if you apply for i-130 while the 129f hasn't been cancelled (we all know uscis is super busy, they certainly don't drop everything and do it the moment you call/email/write) then you could potentially have two applications being processed at the same time.  Others who have applied have gotten RFE for this issue until it was resolved, or, at the interview stage, received AP for not having the proof.

I mailed and hand written letter yesterday requesting the withdrawal of i129f. I used fedex and asked for a signature. I think that s proof enough.

Have you gone his route? Included a letter to cancel the I-129 F with the I-130? Someone says it is necessary to have the withdrawal confirmation on a hard copy from the USCIS and that can take six months to receive it.

@Adil & Jeanne I believe her case was much more complicated, took many years to process and has 5+ years ago so what she did may not be applicable now?

It's proof only you sent a letter. You can't prove the contents of what you sent nor that they actually cancelled your k1 until you have a hard copy proof of it.

The letter has REQUEST FOR I-129 F WITHDRAWAL right above the address. My case has not been approved yet. It is still at the center, so I am hoping it will take just a week or so. Can I check on line? can I mail them to withdraw it too? thanks

By the time they get around to opening the withdrawal letter and actually processing the withdrawal (given how slow USCIS is), your case may very well be approved. You are (were) looking at an approval sometime in the next few weeks. Until you have the confirmation letter that your petition has been withdraw, it is still considered active. IF you get your NOA2 in the next few weeks, you will need to go through further steps to withdraw the case at the NVC/consulate level.

Hi All,

My Fiancee and I have given up on the K1 Visa. I plan to fly to her and marry asap in order to start the CR1 Visa.

Please advise me on how to cancel the I-129 F in the shortest time possible. Can I start the I-130 right after marriage? Or I must

cancel the I-129 F first?

I had suggested we don t marry where she is, and wait until she came to the States. She was not too happy for this Fiancee visa, but I had assured her

the process took just few months to 5 months tops, and she d be here with me by October. Apparently, this will not happen. She was right and I was wrong.

I appreciate your input in this urgent matter. Yes, it is urgent because she is very upset with me for making false promises. She ll get over it soon tho :)

Thank you,

Hey my friend....no one is right or wrong here. Just last year the process was so much faster. You had no way of knowing everything would slow down like it has. My fiancé and I are May filers with a NOA1 date of May 15...we are frustrated and very anxious too. However, I think you guys will be together faster with K1 process as you are well into it. (I see you on the May filer's thread :) ). I know this response is not much help, and just an opinion, but you are so close to NOA2...after that, it should go by quickly. Please don't get down on yourself, most of us have been canceling wedding plans, visits, etc., as we thought our loved ones would be here by Thanksgiving when we started....now we hope for Christmas!  Best of luck sir.
