Hi, I am new here and please I need help.

 

My husband is a US Citizen, but due to his job he keep a residence in Brazil and a rented apartment in US. He works for na American company.

We got married in Brazil and we have a child.

2 years ago, before getting married, I tryed to get  a tourist visa, but it was denied.

I would like to go to US, but just for visits. I work in Brazil and I don't want to move to US.

I could get the IR1/CR1 Visa, or K3, but I don´t know if I will be able to keep the green card. I can travel 2 or 3 times a year, but not more than that, and just for some weeks, not months.

I can try the tourist Visa again, but I saw some topics here showing that the US Immigration cancelled some tourist visa recently  because it is not the correct Visa if you are a spouse.

Please, could I have some suggestion about my case?

nope, the GC is for living in  the US, if one day you decide to permanently move to the US, your husband will have to file the i130 for the GC

 

the only visa you have is the tourist visa , you can try again and take evidence to prove that your husband is staying in Brazil, job, apartment lease

 

any proof to show that you must return to Brazil, strong ties to the country
