Marital Status Documents needed for unmarried finance?

Hi Everyone

 

My finacee posed a question about whether for not she needed to still provide documentation that she never married and is single .  The K-1 visa instructions says to provide marital status documents for proof of legal separation.  Does this apply for fiancee who never married, single and has no out of wedlock child?

 

Marital Status Documents:
 Applicant’s evidence of the legal termination of any prior marriages (Copy and original of divorce decree or death certificate of ex-spouse, if applicable).

No, it clearly states there that they need any evidence showing the termination of any prior marriages. If your fiance has never married then you don't need anything, if you were married and then divorced then you need to provide evidence that you got a legal divorce.

At the US level they do not need that from your fiancee. I do not know how Vietnam does it if they have to get one from Vietnam. But if it's required for your fiance it will be at the Embassy level not at the USA/NVC level of things. So ask your fiance if she has the "certificate of no impediment to marriage" from her province.

I wish people unfamiliar with Vietnam would stay out of the Vietnam portal. Maybe you should find a hobby or something. To answer the question, you don't need anything if never married. My K-1 fiancee didn't supply any paperwork stating that she was never married.  Not such a thing in Vietnam for single people.

There is and it's called Single Status Certificate that you can get by filling out a form at the local People's Committee where one resides. I asked my then-fiancee to apply for one and it took all of 15 minutes or so. You just need to bring your House Registration (the Red booklet) and your ID (Chung Minh Nhan Dan).

 

You don't need one for a K-1 as previously stated, however.

thanks for clarifying.   According to my fiancee, she has the Single Status Certificate which expires  few days before the visa interview.  Apparently, Single Status Certificate expires after 6 months it is issued.  

if she doesn't need it to show at the k-1 visa interview then i won't tell her to get a new one.

Then what's the point of your post. The question was for a K-1. You don't need anything for a K-1. The rule in Vietnam is don't request anything that is not needed for U.S. immigration. It's hard enough to get stuff done without "coffee money" and/or waiting forever. The "Single Status Certificate" you mention is nonsense. Not needed for people that have never been married. It's not the Vietnamese that set the requirements - it's the Americans.

The point is that you said there was no such thing in VN and, in fact, there is.

One of the advantages of doing a K-1 is that the Vietnamese authorities are completely out of the picture. The K-1 applicant only needs to deal with the US Embassy or Consulate. Since corruption is so endemic in VN, not having to deal with VNmese bureaucrats is a huge relief. A drawback of the K-1 visa is that the beneficiary will have to request a green card in the US, and pay about $1,200 in application fees to USCIS. To me, the $1.2K is well worth not having to deal with the leeches in VN.

I have helped several friends and acquaintances with the K-1 and CR-1 visa processes so I am unfortunately too familiar with the sorry situation in VN.
