I've traveled to the US on numerous occasions. In may 2015 I traveled to Houston and stayed there until January 2017 which I did voluntarily depart.  Now me and my high school sweetheart has decided that we are gonna get married (she is a US citizen). I don't have any criminal records whatsoever in the US or anywhere in the world. She lives in the US and I live in the Caribbean. So my question is what's the procedure or my penalty before returning to the US to be with my wife?

In 2015, by what visa did you enter the US?

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You overstayed so worst case is you face a ban for a limited time. 

11/30: Sent I-129F package to Dallas Lockbox


12/01: Petition recieved and signed


12/03: NOA1 text recieved @4:23pm


12/03: NOA1 Email recieved, sent to CSC


12/07: NOA1 hard copy recieved

 You are currently under a 10 year ban from the us for overstaying a visa more than a year.  Your girlfriend can file, you WILL be denied at the interview and told if there is a waiver available to you.  That waiver process will delay you by another year or so over someone without a ban.

This will not be over quickly. You will not enjoy this.

6 months ish is the going time for a waiver.
