Hello everyone, I am having a problem with my wife wanting to go home after we sent in the AOS about a few months ago. My biggest issue is that I already paid the $1,200+ to the USCIS and I cannot afford to buy a plane ticket right now. I have been supporting her but also buying things like concert tickets and clothes, we planned on saving more when she started working. Is there any possibility of getting any of my money back from USCIS so I can buy her a ticket? I can continue to support her and let her stay with me and save for the ticket, but she really wants to leave NOW. I don't even know if she will stay with me, she has even gotten upset and wandered the streets before, I'm a little worried for her safety. If anyone has any other solutions they can think of it would be appreciated, thanks.

USCIS does not refund application fees, under any circumstances.

 

Sounds like she may be going through some other issues other than maybe homesickness if she's wandering the streets and you are worried about her safety. Have you thought about setting up some sort of counselling for her/two of you?  There are free/low-cost resources out there to look into...

It might just be her being homesick is all. Where is your wife from and is she able to call back home to talk to family?

If your marriage is salvageable...and her only point of contention is living in the US...perhaps you may want to consider moving to her country.

 

How long was she in the US before all of these problems started?  It could have been the result of culture shock messing up her mind a bit.  Happens to all of us on some level.

@Op I am sorry about how your wife is homesick and wants to go back. Well, You can only do so much to help her or assist her.. life is not fair.

 

Out of curiosity "where is she from? What is her background? how long did you knew her?"

Option 1) Stay and try to make it work. Get counseling.

Option 2) Divorce and she can return home if she wants (she can deal with how to do so herself).

Option 3) Go with her back to her country and try to make it work there.

 

USCIS will not refund you.

Then tell her to ask her family for money or tell her to wait until she gets her EAD. Once she gets her EAD she can get a job and work like an adult and pay her own way home. Out of curiosity, what country is she from originally and how long has she been here?

She might be homesick. But it also might be that that's not how she imagined your married life to be.

I don't know what country she's from but maybe she expected you to be wealthy (judging by her country standards) and now is disappointed. Who knows? Anyways, like others have said - tell her to buy her own ticket. You don't just go to live in another country without any savings. That's not how adulthood works.
