Hello,

My husband mailed in the I-765 separately under I-485 two weeks ago and today we received the I-797C. After reading the notice we are a bit confused of the I-765 situation. I attached a screenshot of what the notice states.

My husband applied for a new new card under I-485 but right now he is under his OPT EAD. According to the notice, it doesn't seem like he will get a new EAD card until his OPT EAD expires. The notice doesn't seem to state anything about the EAD my husband is applying for but is referring to his current one. Am I understanding this correctly? Or is this notice is telling us to wait and USCIS is still trying to process the I-765 form and we should receive another NOA? So for now, we don't need to do anything?

It isn't talking anywhere of his current EAD. It's just the receipt notice of the i765. You will now have to wait 3-4 months for processing. All the wording on the receipt notice is standard.

That makes sense. I thought it was referring to his current EAD. I was getting a bit concerned since I thought this notification letter will indicate an appointment time for his biometrics.

Thank you! We will rest at ease until then.

I totally understand your frustration, the process for GC is really nerve wrecking...just wait and be patient. The serious nerve wrecking part is still ahead though... Until you get the GC, it might be like this........ Not trying to scare you but hey USCIS process for GC is totally unpredictable... At the end it is worth all the nervous frustration.....

Good luck
