Just wanna ask if anyone have the same situation as us and the chances our case might get denied.

 

Details: Me and husband were college sweethearts and he purposed to me in front of the most iconic statue (where people from our school like to purpose after graduation saying it will be a yes if you do that, kinda a tradition:))at our school after we graduated. Then we moved to California and got married. We're just like all other broke college graduates trying to make a living here. My parents helped out a little bit in the beginning and then we were on our own. We have been struggling financially since because the paychecks and living expenses just don't add up in California. I'm good at managing money and bill dues and my husband is a very carefree person and don't really think about next month. We have a joint account that we use on a daily basis. I guess because we use it so much, the account got frauded twice somehow (some unauthorized transactions). So we had to close it and open it again a few times. So we really don't put a lot of money in it (just enough) to spend. For that reason, my work direct deposit is set up to my account that I don't swipe, for rent, and his checks cash to our joint account to spend like groceries and stuff. We're both under 26, so his health insurance is still under his moms and I got mine through work. We've moved a lot. We were living in a very nice complex that we couldn't really afford (I know, not a wise decision) and had both our names on it. Then we lost our jobs and had to move out in a week. Because we were really rushing to find a place to stay, we decided to let me do the talking and find the place first and once we moved in, we will add his name on the lease since I have a much higher credit that could get us somewhere sooner. Then we moved in to the new place, and asked if we could add his name on it. Because of his low credit, the management said we had to pay 10% more in order to do that. And you know what, we decided just to have my name on it and add his when we saved more money. I guess we really just weren't thinking too much about the green card situation thought we love each other, and we can pretty much answer whatever questions they have for us with absolutely no problem. But now thinking back and reading all other stories, we started freaking out. We literally could get more documents together, but were just trying to save some money. Now we're thinking moving again, and no matter what, definitely need to find a place that accepts both our credits. 

 

Anyone had/have similar situation that got denied or approved? Any chance that we would get denied without an interview? An interview would be great really because there's nothing we don't know about each other (seriously anything and everything you can think of 😆)

 

Documents that we sent in:

1. joint bank account statements (but rents weren't coming out from this account)

2. jointly filed tax returns for the past years

3. Renters insurance together

4. Dog adoption paper (we rescued a pup together)

5. Travel together proofs 

6. Photos of us and both families and our dog

7. Neighbors statement that saying seeing us together all the time (since his name is not on the lease)

8. Mails that have both our names on them 

 

 

Sorry for the long post. Any inputs would be appreciated!!

I think you're overthinking this.  Having both spouses' names on a lease doesn't make or break an AoS case.  My name isn't on our lease because I can't work yet and our landlord doesn't want me to be added until I'm employed.  So we'll be doing that after I get my EAD/AP card and get a job.  We'll most likely bring an updated lease to our interview.  If anything changes between now and your interview date, bring those papers in (for example, his name gets added OR if you guys get a car/vehicle insurance/other insurance together, etc).  

 

We wanted to get our landlord to write and sign an official affidavit stating we've been living together since we moved into our apartment.  But she's kind of unreliable and we didn't think she would get it to us in time.  So we just decided to forget it since I'll be able to add my name to the lease by the end of this year.  In any case, if USCIS has any questions, they will ask at the interview.  That's what that step's for.

 

BTW, just out of curiosity, how long have you been married?  Are you the USC or your husband?  Which country is the foreigner from?  And are you guys adjusting status or removing conditions (it says "Removal of conditions" under your username, but your situation sounds more like adjustment to me, so I just want to be sure)?

I really don't see why it can be denied without an interview.

You are right you are dealing your issues as an ordinary and very normal couple.

This is not really a math problem, this is real life. If you have to move to a lot of places is fine. I think that the most important thing are the questions asked during the interview and there is when all that histories need to be well  answered in a clear way. Only if the Officer ask. Keep in mind that you should only need to answer all the questions that may come up.

Thank you for the response! We have been married for 3 years. We are removing the condition right now. My husband is the US citizen and I'm from China.

I'm not sure if this post belongs to IR-1/CR-1 progress. We just filed i751, so I don't think it's adjustment of status. Thank you!

Thank you! I guess we're just really over worried given that there're many condition removal cases that have more evidence than us and still get denied.

You look like on here like there is more than enough evidence so don't worry. Actually hope that you get an interview because that usually means that is quicker than ROC without an interview. As one poster said above don't over think it and just provide the evidence you have. There really shouldn't be a problem at all.

Not a problem we are here to help. It is almost always the case of wanting to over think things when it comes to immigration but in cases like this there is no need to and you should be fine.

Well, I have rarely seen a couple of I-751 applications denied after RFE and interview, which turned out to be after-divorce waiver filing or due to mistakenly missing interview cases. As long as you filed I-751 with your USC spouse and your evidences show that you and your spouse as a married couple have maintained financial responsibilities and ongoing relationship during your 2 years of marriage, there is nothing to worry about. 

 

However, do expect interview if you are not super-confident about your documents (some couples have birth certificate of child born to them as evidence, which is really strong evidence). But interview will go smooth if you are prepared.
