Hi Everyone,

I am new and i need an advice PLEASE.

Moved to the US two years ago through fiancee visa and I'm on my 2years temporary visa which will end very soon.

My issue is that i married a US citizen when i was in Europe. We had issues all the time and we decided to separate. I called her one day and told her I need to move on with my life and I want us to divorce. She said no, that its against her belief. I tried so many times and even involved lawyers. So i stopped bugging her and moved on with my life. 5 years later i met the love of my life and we decided to get married and start a family(We have 2 kids now). She is a US citizen too. We filed for k1 visa and it was approved. I got my work authorization and 2 years temp. resident permit.

Last month, my ex that didn't want me to divorce her sent an email to me saying we are still married that I should do anything she says or she will report me to the USCIS. I told my wife and we decided to talk to her. She didn't listen to what we have to say and decided to contact the immigration. She sent an email to the USCIS fraud dept with the scan copy of our previous marriage license and told them to deport me. I was shocked.

Last week, I spoke with my ex and she was feeling sorry for what she did. She said the USCIS has not contacted her by any means. I don't know what to do. I'm supposed to renew my green card in December. Do anybody know how the USCIS fraud dept works? They have not contacted me either. Should I go ahead and apply for removal of my temp. resident permit? I need help, please.

So if USCIS didn't go after the tip, you would evade the system one more time?

I suppose it's easy for anyone to state they are not married on the form, when in fact they are.

USCIS asks for proof of marriage with applications, when checking "yes"....not proof of one being single, when checking "no".

I'm going to garner a guess that he just put "no".

When you file you are suppose to provide a divorce decree at same time with application. I had to provide the first 10 pages of mine.

I don't see the op ever coming back to this thread. he has been given the same answer over and over again so mabye this thread should be locked before it gets even more out of hand?

He knew what he was doing he just wanted to get into the U.S.A. by any means possible, that makes it bad for the rest of us that is why they are cracking down on fraud.

It really baffles me that some people can abuse the system like this while a lot of us are still waiting, doing it right and frustrated.

I realize this is why we have such a long and complex process, but it seems that a lot still fall through the cracks and get away with it.

I want to be empathetic OP I really do, but you're an adult and you made a big mistake while not divorcing the first wife and marrying the second one without seeking legal help. Even in the paperwork it states that you have to disclose a previous marriage. Now you're risking deportation and affecting your current wife and kid's lives.

If you lied in the application that's misrepresentation and they take it very seriously.

For your sake and you familiy, I do hope things work out.

@dawning yes I did actually read the original post...it stated that the second wife is a US citizen and then after that it stated that WE file for a K1 visa and it was approved so like I said thinking like a CO officer or the people at the USCIS I would think that he knew her before his marriage to first wife so even if the children was born in the US...its not stated how the second wife got here to the US or was she born here...and also he stated that he got lawyers involved so why didn't the lawyers take the case...its not stated in the first post....he still put himself at risk of being deported or even if his second wife and kids are US citizens....but its very obvious that there is more to this story

And then to find out the country is Nigeria...This is  why Nigeria is one of the toughest Embassies to go through because of people doing shady things and messing it up for others..You should have done right in the first place by informing them you weren't of the market or better yet, got a divorce which was the right thing to do..As one member has stated, Lawyer up because you have made a mess!!

This thread is now locked, for these reasons:

1.  The OP is receiving the same advice over and over.

2.  At minimum, he must seek help from lawyers now.

3.  Posters are becoming assumptive and presumptive (some posts have been removed).

4.  The thread treads on this provision of the site's Terms of Service:  "Condone or instruct, either directly or indirectly, others on how to commit fraudulent or illegal immigration activities in any way, shape, manner or method."

This thread is not to be restarted or referred to elsewhere.
