Typical case of piggyback... He will divorce his current wife.. and bring his old wife back..   Just FYI, If you plan to do this.. USCIS will reject your case.

Why bother with that? The original wife is a USC.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Well within her rights to notifiy USCIS report the fradulent K1 application.   I'm not sure you would be shocked that you were still legally married to the 1st wife since you never got a legal divorce.

  They would not necessarily need to contact her, since they have the marriage license to go on as proof you are legally married to her.  I presume it would take a simple and quick check by them to verify that there was no divorce filed within the US on either of your parts, and then take a look at your AOS application again and see the documentation submitted regarding the second marriage.  They won't necessarily contact you either until their investigation is complete--most likely when you receive the ROC denial and/or notice to leave the country, that would be their means of reaching out to you.

 

Of course, it's also possible the first wife never contacted USCIS in the first place and just told you that.   Or, she just notified them recently and therefore it's too soon for her/you to get some sort of response from them.  In any case, you need to contact a lawyer, and prepare for the worst case scenario...because even the best immigration lawyer probably can't do much to save you from the blatant misrepresentation on your K1 application, and your AOS application.

I am wondering when he filled out the Petition Papers, under " have you been married or divorced" What did he say? How did this did not come up as a red flag at USCIS? As I said, sooner or later it will come up and he will be questioned and the end is not going to be a happy ending.

You are right, USCIS might not have checked since he left it blank, but, if he is lucky to get by the removal of conditions, still, when it comes to applying for citizenship it will come back to hunt him and might be a reason to deny him being a citizen.

If you did not read the entire thread I suggest you do so.  Others have apparently made it all the way to citizenship with high security clearances but yet have "forgotten" they were still married to someone else.  It may catch up with them eventually, and it may catch up with the OP, but I wouldn't bet money on it.

He hasn't forgotten. He says in his first post that he knows he was still married. He thought that as she didn't want to divorce, he would just move on with his life. It doesn't work that way

I think this was asked, but I did not see a response to this, if I missed it ignore it, if not, we need to know about this precious tidbit so that we can stop wasting time on assumptions and offer help (and move on to helping someone else who goes through the pain and agony and a proper divorce before getting re-married).

 

Sorry (not sorry) for the judgmental remark, but this topic triggered me :whistle: -- I bled for 18+ months trying to get it done and had to do it all by myself (from drawing up the paperwork to filing it, to coming to an agreement with my ex). No excuse, none that can justify this for me. 

 

Moving on -- my question is, what did you put down/mention on your K1 visa application (your communications with the US Government) -- married, single, widowed or divorced?
