employer benefits to sponsoring an H1B

My girlfriend ( Canadian Citizen ) , may have employment opportunity to work in the US. The employer is unfamiliar with the process, so we are doing the research on our end to show the benefits of sponsoring an employee. Does anyone have any benefits for the employer to sponsor an employee? I am coming up very short on our research.

What is her degree? And what is her field of work in??

Canadians can do a TN Visa which is so easy and simple and you just need a job offer letter and can get it anytime at the POE! Therefore, they dont need a sponsor and the employer does not need to pay anything.  

 

H1b is super hard and its been full for the year.

You will have to do the TN. The problem is business, marketing and sales are not job titles. You would have to go under management consultant and get the job letter based around that requirement. It is heavily scrutinized as well.

The main benefit is usually cost, you pay someone less that a US Employee.

 

The Employer needs to consult with their Immigration Lawyer. Devil is in the details which nobody on here knows.

Guest workers should be paid at least the prevailing wage. Work visas are not designed to undercut the wages of US citizens or legal permanent residents.  An employer who is unwilling to pay the employee the value of the position is unlikely to treat the employee fairly in other matters.

 

If the employer is unfamiliar with the work visa process, the employer should hire an immigration attorney to advise him. It is part of the cost of doing business. It is not your girl friend's responsibility to advise her prospective employer of the advantages or the process of hiring a guest worker.

 

If you want your girlfriend to come to live in the US with you, you need to consider marriage.

I am aware of it.  However, a prospective employee can be hurt by an improperly constructed employment letter and inadequate documentation.  A "good" employer will not do the process on the cheap.  An employee that is a good fit for the position can be hard to find and harder to keep.

 

Unless a person is very experienced in the process, they should be taking advice from the employer's HR department's immigration specialist or the corporate attorney.  If the employer will not provide this, the individual should take an appointment with an attorney to go over their documents, to make sure they understand the procedure, and to understand their rights and responsibilities as a US based worker.

 

There are far too many horror stories of workers being taken advantage of by disreputable employers.  OP is likely to be OK, BUT it is better to be safe than sorry. OP's boyfriend is not the best person to look to for advice.
