I just want to

get straight to the question because my story with my abuser is or was a long one. My question is, i filed i360 vawa and I did get my prima facie notices and even extended it and got it, but I am kind of worried because I am still legally married to my abuser. Does that mean my i360 wouldn't get approved or do I get a divorce.  Please I need to know so I can start the divorce processing.  Thank you for your response.

You don't need to be divorced to file I-360(Vawa).You can divorce when you want ok.

 

VAWA Law allows the person to file VAWA when still living with the abuser,but USCIS will not take slighlty if the person is still living together after VAWA approval.Vawa Law was enacted to help people fleeing domestic violence.
