Apply for K1 - Do I need to go overseas for Engagement?

Hi Everyone,

  I want to marry my girlfriend but she is overseas.  I want to bring her to the states on K1.  The first requirement for K1 visa is an engagement but I am unable to go overseas for an engagement.  Is there any other way I can apply for K1 without going overseas for engagement?

I believe the rules specify you must have met within the last two years unless your religion doesn't allow this.

 

Have you met her in person? If so yes, you can apply as you'll be able to prove you've met her (I assume) with photos etc.

You dont need like rings, a party, etc to be engaged, just am agreement that you want to, and are legally able to be married. Has she been here to meet You? If you can't go to her country for safety reasons you could perhaps meet in a third country but you must meet in person in the past two years.

As above. A ring isn't a symbol of marriage or engagement.

 

My wife wears a wedding ring but I don't. It's not indicative of anything.

Basically, OP, if you and your girlfriend agree that you are engaged and want to get married, then you are engaged already for the purposes of the K1 visa. So really she's your fiancée -- congratulations!

They have to have seen each other in person in the two years before filling though. Essential requirement.

I want to Thank Everyone for their response.  We have met in the past two years, but during that time period I was going through a divorce.  After I got my divorce finalized, I have not met her since then.  So the point that I am at right now is

1. We have met before but at that time I was married and going through a divorce. 

2.  Since the divorce, I have not me her. 

 

At this point, do I need to meet her first to establish an engagement and then file for K1?

No, you don't technically have to meet her again. However, they are likely to have increased scrutiny of the relationship so any additional time you can spend together is a big plus.

 

What embassy is she going through? What is her nationality? Do you have any red flags?

Geowrian congrats for me as well.

 

My only red flag is that I was married and now I am divorced.

 

She is from Pakistan.  She will be going to Karachi consulate.

Pakistan is considered a high fraud embassy, so more than 1 visit is suggested. It doesn't need to be before you file, but getting plenty of face to face time is preferable. Good luck!
