Hello!

 

I recently responded to my second RFE about a week ago (work permit and advance patrol approved). I wrote a cover letter with detail (explain how my spouse's asset meets the poverty requirment). 

The tax income is low and we were not able to find sponsor but my spouse has enough to meet the 3x difference (asset) therefore I explaied that in detail. Now I dont want to receive any RFE PLEASE!! Do they read the written cover letter? 

Also, is that a great/huge probability for them to deny my case? This waiting game is no joke!!!!! 

IF anyone has any idea, please please share with me

They should read it, but there's no guarantee they will nor that what they read will satisfy the requirements for them. You need to 1) prove ownership of the asset, 2) show evidence of its current value, and 3) Show that the asset is convertible to cash within a year (and without considerable hardship to the sponsor).

 

Moving forward, they will either:

1) Accept the evidence (if this is at NVC, then they will probably defer a decision until the interview for assets).

2) Issue a 3rd RFE.

3) Deny the case.

 

What type of asset was it? What supporting evidence did you provide? What process are you going through (visa/AOS) and what stage are you at?

Hello geowrian!

 

It ia familty based AOS case (married to US citizen). I am at NYS (NYC).

The asset and evidence, I sent 12 month personal bank statements, no need to be converted cuz it is cash in a US bank! So I am hoping for them to read this time. I responded to first RFE last time without explaining in detail (without cover letter) and for this second RFE I spoke to immigration attorney before responding it and what came up was the cover letter with detail explanation. Im hoping for them to read it and pass my case for interview! It has been a while!!!

Thanks for the update! For AOS, this should be sufficient. Having a letter signed from the bank with would have been nice as well, but isn't required. I think you'll be fine.
