My husband and I have been going through some rough patches and we've brought up the discussion of divorcing... I'm wondering if this will affect my eligibility to renew my green card (I received my conditional green card about a month ago).
Our documents include:

 

- beneficiary on retirement/health insurance

- beneficiary on airline benefits

- joint car insurance

- joint bank accounts

- joint creditcard accounts

- marriage photos/invitations, etc.

- photos and documentation of our ongoing relationship (letters to both of us at our US address, etc.)

 

If the relationship ends I'm going to most likely travel abroad with the savings I have for 2-3 months, while having a new US address and bank account, etc.

Would I have problems getting my conditions removed if I choose to file separately?

You can remove conditions with a divorce waiver. You must satisfy them that the marriage was entered into in good faith. Seems a shame for it to be over so soon. Have you tried counseling or maybe just a break for a short while might be enough? Have you been home at all since you moved here? Homesickness can cause a lot more problems than people initially think.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Counseling is very expensive, but we've certainly considered it; we have always considered a break.
And no, I have not been home since getting the K1. Our marriage in Michigan was the last time I've seen some of my family unfortunately.

So if I travel abroad 2-3 months after our divorce it won't affect my eligibility? As long as I can prove that it was entered in good faith?

Eligibility no, but chances of removing conditions, a little due to the short nature of your marriage at current.

 

While you did not ask for relationship advice and you are free to ignore it, I do think that you may need to allow life to settle down and just flow for a little bit.  I suggest headed back home to visit family for a week maybe because of homesickness.  As much as we are alike to the USA, we are not the same.  Our family is not near.  Most people are not like me and haven't lived away from family.  Have you two considered a vacation together perhaps?  Unless the person you married really isn't who you thought they were or there are irreconcilable differences/issues you haven't really had a chance to be just a married couple without stress looming.
