Believe it or not I am also a derivate on my husband's employment visa, and I have applied for a waiver with my dad (USC) as a qualifying relative. I couldn't find one employment - based case with a waiver. Our lawyer said that our case is very unique, but that we have a very good chance in getting processed via consular processing.  I hope he's right! I'm so stressed over this whole process.

Oh wow, I am so glad you are also able to apply to the waiver. Yes, our cases are news since this expansion was recently made. Did you get your waiver approved?

Hey guys does anyone have any advice on how to get the police certificate form Mexico? I am having such a hard time, our nearest Mexican consulate is not helping, they don't have any appointments available to get power of attorney. They said he can just walk in to get his finger prints done but that to get power attorney we need an appointment which they don't have

Our attorney didn't do anything like this...We will be traveling to Juarez a week before the interview.. We will personally be picking up once we are there..He gave us the address of where to go, told us it's a one day transaction. It could be because our's is from the state of Chihuahua.

CONGRATULATIONS! How exciting! That was fast.  What type of immigrant visa are you applying for? We are EB3.

Yes, very thankful for the expansion. No my waiver is still pending. We have sent it in end of September.  Hope everything goes well with your case.

NVC won't give us an interview date until we send them this.

Then he needs a police clearance from Mexico, since he was over 16.

I am having a hard time getting it without him having to go to mexico himself in person :(

Have you reached out to the Mexican Consulate? i believe you  can make a document through the consulate and have some family in Mexico get it in his behalf  and have them mail it to you here.

Yes I tried but they said they do not have any appointments right now. I keep calling but they keep telling me the same thing. I wonder if i can get power of attorney elsewhere.

You probably could. A power of attorney is a power of attorney. The special thing about the Mexico consulate is they verify that you are indeed from Mexico, but are indeed here in the USA. Are you contacting Mexitel to schedule an appointment? I hear it is easier to receive an appointment from them (I have never personally done this, but it has been recommended to me). You may not need an appointment (at least we don't have to have one at our local Mexican consulate). My recommendation is to contact the local fiscalia general del estado (FGE) in Mexico. You can google their location with phone number. This is where you will be able to get la carta (o certificado de no antecedentes penales (police certificate). We were told to get the carta de no poder (power of attorney) from the Mexican consulate here in the US, send this to Mexico for a family member to obtain, and for them to send the carta de no antecedentes penales back.

DO NOT STRESS IT! If you are unable to obtain a police certificate from Mexico, you may send a letter with your civil documents to the NVC stating that you are unable to obtain a police certificate and will present at the interview. Contact the NVC for more information on what to include.

We were able to send my hubby's certificado de no antecedentes penales with our civil documents. BUT, I have seen (in FB groups) that most either obtain a federal police certificate in Juarez OR leave early to their hometown (if this was the only state they lived in since age 16 for 6 months or greater) and obtain the carta from their local FGE, presenting them at the interview.
