CRBA for child of divorced parents

My ex wife and I are naturalized US citizens. My ex wife gave birth to my child in India.

I've done DNA tests in India to prove that he is my child.

She does not want custody of the child. We have the divorce finalized. She does not want to accompany me to the us consulate when applying for the CRBA.

I don't have any pre-natal records and she says that she destroyed them.

Can I still apply for the CRBA for my child?

What supporting Documents do I need?

Is there any way you can get the documents (or any documents) from the hospital she gave birth at?

The DNA tests won't help you much in immigration terms, unless they were ordered by the embassy directly through a UCIS accredited lab.

if I were you I would make an appointment for a CRBA at your nearest consulate and apply for the CRBA. A copy of the mothers US passport will help, since a child born to two (married) USC parents, you will not have to fulfill any physical presents requirements. And show them the DNA. Most likely you will have to do it again, but at least this way you will not have to show any pre-natal records if the mother destroyed them.
