We just filed AOS for my husband in Illinois and when we asked the DMV above driver's license requirements they informed us that the EAD is required.

He did file for a SSN a few weeks after he arrived, so we already have that. Now we wait for the rest of the AOS process and for the EAD to arrive. We just sent in our petition last Friday so we will be waiting awhile.

This is VERY helpful information.  Thank you so much for sharing your experience.  We will definitely keep this in mind.

also, he won't be able to get a drivers' license without a SSN. And depending on your state, he may not be able to get a drivers' license without a green card or at least EAD (i-765).

Although looking at the Texas requirements, it looks like he may be able to get a DL based on pending i-485 (so after marriage, after he gets his notification that the petition has been accepted) - https://www.dps.texas.gov/DriverLicense/documents/verifyingLawfulPresence.pdf

Someone from Texas may know better

i am from Texas. with regards to driver's license, it is better to wait for the EAD before applying for one. Though they will issue a Driver's License while pending AOS, the Driver's License will only have 3months validity. This is based on your I-94 expiry date.

I applied for SSN before marriage/filling AOS. Prior to having my EAD approved, I find having my SSN very handy mainly for enrolling a joint account with my husband's existing bank account and insurances. We needed it for tax purposes as well. I'd recommend to get a SSN before I-94 expires.

Whoa......$1,140?!  For what?

Please break down each fee...the only one I see is the $410 for the I-765.  This citizenship stuff is expensive!!!  LOL

Me thinks it's a bargain!  Good luck

Sorry for the late response.  Came back to the site to get the steps again as we proceed and saw your response.  Thank you for that info re: Illinois.  We are headed to get his SSN number tomorrow and are working on the other forms (I-485, I-131, and I-765) and plan to drop it in the mail on the same day as our wedding.

Thanks again for your input.  Everyone is so helpful on this site.  I love it!
