IF the petitioner never informed the Embassy of the termination of the relationship or has never cancelled the visa, the beneficiary could still get the visa under the guise that they are still together and all is well. It will be a huge lie and big risk but it could be done and we have seen it.

The problem is the K1 visa is tied directly to the petitioner and once the beneficiary is in the US there would be no way to gain legal status UNLESS they convince the original petitioner to do so. So ultimately without the petitioner they would be illegal. For some, just getting on US soil is enough.

There was a guy a couple of years ago that shared his K1 story. He waited in the airport for his fiance who never showed up. After some investigation it turns out she used the K1 visa that he applied for to enter the US so she can be united with her real boyfriend.

OUCH!!!!

I just want the OP to realize that if she decides to lie to get into the US and at some point the US finds out, she may never be given another chance.  She needs to think very clearly about this as it will take a big lie to get passed the CO.
