what is the longest you can take to submit forms before they close your case?

Hi,

I have just been approved for the I-130, which is great news.  However, since applying, we're now in a place where it's really not ideal to move ASAP.  Therefore, does anyone know the longest amount of time you can take to reply to NVC or submit documents before they close your case?  we still want to proceed but at the slowest possible rate....i've heard you have a year to reply?! can anyone confirm please?

Timeline

NVC keeps the case active for one year from the date of last communication.  Every time you communicate with them resets the 1 year clock.

March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Theoretically, yes.  However, it's best to think in terms of "official responses" not just communication.  If you are wanting to delay, you also communicate that.  Once you've sent them everything you can also ask them to delay the interview until a certain month.  No matter when the interview is, take updated supporting documents for the affidavit of support and a police report less than six months old to the interview.

 

One of the best delaying tactics would be to leave out a required piece of information or documentation for the affidavit of support.  They'll complete the case with a missing civil document but not with a faulty affidavit of support.

thanks for letting me know.  so I can request the interview date to be at a certain time? is it best to communicate that in a letter with all my documents?  ...can I ask how you know they'd be okay with requesting a later interview date?

well seeing as it's only just been approved and needs to go to NVC, i'm not sure.  say everything is completely approved and completed in the next 6 months, we'd be looking at early 2019 if possible

I did not indicate that you could request the interview date be at a certain time.  I said you could request that it be delayed until a certain month.  (or AFTER a certain date)

You probably can start sending the required information to NVC in July 2018. Leave out a required document or two which would then create a checklist.

Once you send the required documents, that would start the clock over for about another 8-11 weeks. NVC would probably be reviewing everything by November 2018 and assuming no more checklists, NVC will then submit your file to the embassy.

You may get an interview by January or February 2019.  If approved, you would have 6 months to travel before the visa expires.
