My husband needs visa to travel to USA to accompany me to see family for 2-3 week visit

My husband and I live in Nigeria and have been happily married for 4 months. We would like to travel to the USA to visit my parents and family and friends for about 2 to 3 weeks. It is very important that he gets his visa, so can anyone help us on if the tourist visa is the one we apply for? Also will he need a letter of invitation or since I am a us citizen and he is my husband will that be necessary? We would appreciate all the help we can get. Thank you so much!

The guides are very helpful.  If you only plan on visiting and not living in the USA then yes a tourist visa is the appropriate one.  No a letter of invitation is not necessary, needed, or really even helpful.

He has to show why he will return to Nigeria. Does he have a job? A home? Children? Are you returning with him? 

 

Having a US spouse  (esp if you are not going back) shows likelihood of immigrating to the US. It's worth trying but I would say he will likely NOT get a tourist visa unfortunately.

He applies for a B visa at the local Consulate, very much depends on his situation, good job, property ties that he would require him to return home.

 

He is going through a high fraud Consulate and I am sure they have heard every story, the information needed is asked for on the application form.

We are both only going for the brief visit and then both returning back to Nigeria together.

You are welcome.  As the others said its going to be very difficult.  From what I've read about others tourist visa's interviews they do not give you much time to look at your evidence during interview so send in as much information and documentation/evidence as you can with his application. Strong ties and proof he will return are a must.  Good Luck!

Show proof of his ties to his country (job, business, children, home) and also that you as his wife will plan to return and live in Nigeria.
So ties could be joint evidence as well. They want to see the reasons why he would want to return to Nigeria and not stay in the US.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

From Nigeria and married to a US citizen = a miniscule chance of success, but there's only one way to find out for sure.

There is very little chance to present documents and you can't pre-load the application for a Tourist Visa like you can on a K-1 Visa.... As others have said he needs to show why he will return to Nigeria and not simply stay in the USA.   Being newly married to a US citizen is normally a very negative thing.  However, depending on circumstances and how he presents it there may be some hope.   The key is to be confident with why he only wants to go to the USA for 2-3 weeks, why he can't and/or doesn't want to stay longer.   If he is well off in Nigeria (better than he could expect to be in the USA if he stayed illegally) that will help.   If he is dependent on you and your income and that is tied to Nigeria then that can help.  Although it is unlikely he'll need to produce it he should bring a copy of the marriage certificate as well as a copy of your visa that enables you to remain in Nigeria especially if that is an employment visa.

  Bear in mind that the CO, by US law, must assume that your husband intends to Immigrate to the USA and it is up to your husband to show this is not the case.   

IF he does not get the tourist Visa then your only other choices are to a) Reapply sometime later presumably after circumstances have changed.   What are the change in circumstances?  For example if one of you has a significant (positive change in employment).   You have remained married for longer making your relationship seem more legitimate.  He has traveled and returned to other countries that require a visa...       Option b) in the event of a denial is to apply for a spousal visa and travel on that 1 year to 18 months after applying... This is expensive and time consuming. Once the visa is granted and you complete your travels you return to Nigeria and surrender his greencard and at the same time re-apply for a tourist visa for the future which at that point should be a piece of cake as he already had the opportunity to immigrate and choose not to.

The only issue with taking a spousal visa route is that I believe the USC would have to establish residency in the US, so unless they are actually planning on staying in the US, probably not the route to go especially if this is just for a short visit.

 

To the OP, as others have stated, it is a tough uphill climb  for a tourist visa, but all you can do is try.  I suggest putting yourself in the mindset of the CO at the consulate (as they have heard all stories) when gathering your information to show his ties to Nigeria to prove that there is no immigration intent.  The strongest seem to be jobs, children, property etc.  Return airline tickets are not really strong as the COs know these can easily be canceled and used at a later date for whatever reason, and the fact that you are going together it would be easy for the CO to assume that you may change your mind during the visit and decide to stay in the US.  In general, the advice for someone applying for a B1/B2 is to focus on just their ties to return, but in this case, since you are traveling with him, it might be beneficial (and I stress might) for him to show your ties to Nigeria as well and what is making you want/need to return.
