Applied for AOS - what now?

hi, all...

Our K-1 Visa process was relatively smooth, and we are now happily married. We have just submitted our AOS and have a USCIS number. However, I have a few questions (if there is a FAQ/how to please direct me there):

  1. Will I need to show a joint bank account or something like that in addition to the wedding photos, and marriage certificate to prove legitimacy?
  2. Most banks will not accept my A# from the K-1 Visa - do I get an SSN now or wait? If so, where do I start?
  3. When we file taxes will we need anything special for this year? Any place for advice on this?
  4. Is there a list of next steps that we should be doing right now while we wait for the AOS process to go?

Thanks!

1. If you get an interview it's a good idea to bring proof of co-mingled finances among other bonafide relationship proof. In many cases they ask for joint accounts, joint insurances etc. However, if you get an interview early on they fully understand if you don't have so much proof yet as you've only been married a short while. Bring whatever you've got.

2. You apply for a SSN as soon as you enter the country. It can be very tricky to get it after marriage, and impossible when you have less than 14 days left on your i-94. If you for some reason didn't apply for your SSN after you entered the US you might have to wait until you receive your EAD.

3. They will ask for SSN when you file taxes, and this year they even asked for our IDs which hasn't happened before.

4. Check the guides section.

1.  Everything helps to prove a legitimate marriage, but not everyone does a joint bank account.  Other things that are helpful are joint utility bills, joint credit cards, joint insurance, etc.

2.  When does your 90 days expire from the entry on your K1?  In order to get a SSN as a K1 you have to have a minimum of two weeks validity on your I94 from your K1 entry.

3.  If you don't have a SSN, I think you may need to get a Individual Tax ID Number (ITIN).

4.  Make sure you continue to collect items that your receive jointly, anniversary cards, joint invitations, anything that is addressed to both of you and keep it in a box or a file as you will need it when it comes time to Remove the Conditions on the 2 yr GC.

Good Luck!

1. Read the guides for CR1/IR1 visas. There is a good list there and in the wiki for marriage evidences.

2.  Go to your local Social Security office and apply for a SSN.

3.  No.

4.  Wait for biometrics appointment letter then either interview appointment letter or if waived NBC will notify you.

Join the September AOS filers thread.  You should be able to find it in the adjustment of status forum.  There all of the AOS filers of September have conversation of what is going on. It will be helpful for you.
