A couple of years back I received a red-light violation in the mail. I did not dispute and just paid it. Later, I obtained a detailed driving record and also requested for any violations, but DMV letter came with no violation or citation for my car or myself.

When I read N400 application, I saw a question asking the following:

"Have you EVER been arrested, cited, or detained by any law enforcement officer (including immigration official or any official officer of the US armed forces) for any reason?  YES  NO"

Regarding my above situation, what should I pick? Is red-light violation considered as a citation?

Yes it should be reported as "YES" since even though you did receive the traffic violation to your home. There is no harm in saying " YES" for this and as well you have supporting documents as well. Keep them with you during your interview and only provide when asked for those.

 

Again some may say this is not considered as any violation cited by any law enforcement officer but I feel it's easier and safer to put as "YES" on your N400 application as we don't know what is the current trend with USCIS and rules can change anytime.

USCIS Updates Policy Guidance for Certain Requests for Evidence and Notices of Intent to Deny

WASHINGTON - U.S. Citizenship and Immigration Services (USCIS) today posted a policy memorandum (PDF, 113 KB) (PM) that provides guidance to USCIS adjudicators regarding their discretion to deny an application, petition, or request without first issuing a Request for Evidence (RFE) or Notice of Intent to Deny (NOID) when required initial evidence was not submitted or the evidence of record fails to establish eligibility. 

This updated guidance is effective September 11, 2018 and applies to all applications, petitions, and requests, except for Deferred Action for Childhood Arrivals (DACA) adjudications, received after that date. Due to preliminary injunctions issued by courts in California and New York, this new PM does not change the RFE and NOID policies and practices that apply to the adjudication of DACA requests.

“For too long, our immigration system has been bogged down with frivolous or meritless claims that slow down processing for everyone, including legitimate petitioners. Through this long overdue policy change, USCIS is restoring full discretion to our immigration officers to deny incomplete and ineligible applications and petitions submitted for immigration benefits,” said USCIS Director L. Francis Cissna. “Doing so will discourage frivolous filings and skeletal applications used to game the system, ensure our resources are not wasted, and ultimately improve our agency’s ability to efficiently and fairly adjudicate requests for immigration benefits in full accordance with our laws.”  

The 2013 PM addressed policies for the issuance of RFEs and NOIDs when the evidence submitted at the time of filing did not establish eligibility. In practice, the 2013 PM limited denials without RFEs or NOIDs to statutory denials by providing that RFEs should be issued unless there was “no possibility” of approval. This “no possibility” policy limited the application of an adjudicator’s discretion.

The policy implemented in this guidance restores to the adjudicator full discretion to deny applications, petitions, and requests without first issuing an RFE or a NOID, when appropriate. This policy is intended to discourage frivolous or substantially incomplete filings used as “placeholder” filings and encourage applicants, petitioners, and requestors to be diligent in collecting and submitting required evidence.  

USCIS will continue issuing statutory denials when appropriate without first issuing an RFE or NOID when the applicant, petitioner, or requestor has no legal basis for the benefit/request sought, or submits a request for a benefit or relief under a program that has been terminated. 
If all required initial evidence is not submitted with the benefit request, USCIS, in its discretion, may deny the benefit request for failure to establish eligibility based on lack of required initial evidence. Examples of filings that may be denied without sending an RFE or NOID include, but are not limited to:     

  • Waiver applications submitted with  little to no supporting evidence; or
  • Cases where the regulations, the statute, or form instructions require the submission of an official document or other form of evidence establishing eligibility at the time of filing and there is no such submission. For example, an Affidavit of Support (Form I-864), if required, was not submitted with an Application to Register Permanent Residence or Adjust Status (Form I-485).

This PM updates Chapters 10.5(a) and 10.5(b) of the USCIS Adjudicator’s Field Manual and contains an “additional considerations” section. The policy in this “additional considerations” section is not new, and is nearly identical to the policy contained in the superseded 2013 PM.

Thank you for the information. Back then when I applied to GC I got a RFE. How often and for what reasons N400 applicants receive RFEs or NOIDs?

The news specifically mentioned that DACA is exempt, so any application would be affected except DACA. So it is better to provide them tons of evidences when submitting applications.

This NEWS would help people to create and gather more evidences for their future applications.

I've been reading everyone's progress but hadn't posted until now.

 

My case moved relatively quickly until I was stuck in line for an interview for almost 9 months!  I have not seen many people filing in Brooklyn in the forum, so I don't know if it is normal. My friends living in Manhattan had a much quicker turnaround by filing three months before me.

 

I had my interview today; it went really well and was recommended for approval. I had to wait for almost two hours though, compared to others who waited for 30 minutes tops before being called. Perhaps my officer had a difficult case or backlog during the day. The actual interview was very quick, just went through the oath, N-400 application questions one by one, the English and civics test and that was it. Perhaps 20 minutes including small talk, photocopies and walking in/out. The officer was very professional and courteous. At the end, I asked what was next, and was told I would receive a letter for the Oath Ceremony within 90 days.

 

I wanted to share the following, as might be very helpful:

 

1. I travel often, so I had about 25 trips abroad in the last 5 years. I printed a spreadsheet with all the dates, and added a column where I included the page number from my passport where the entry/exit stamps were per trip; for those stamps that were not clear, I brought my airline purchase confirmation, but I was not asked to present them. The officer really appreciated I did this, as it takes a long time to correlate stamps to dates.

 

2. If you are changing your name, you will need two passport photographs for the Naturalization Certificate. I recommend bringing them with you. I did not know, so the officer gave me a G-56 to return with them. I went to the pharmacy across the street and overpaid. Took 5 minutes and then went back to the USCIS office to leave them.

 

3. If you ever had an MTA ticket, you need to get a letter of disposition (office in Joralemon St, Brooklyn). A lawyer suggested me to answer "yes" to the question about being cited, arrested or detained, so I did and added this MTA letter. When asked during the interview, I told the officer I had never been cited, arrested or detained, but that the lawyer told me to answer yes due to the MTA ticket. She pointed out bringing the letter was the right thing to do and went on with the interview. (I don't drive, so I wouldn't now about other tickets)

 

Overall it was a very good experience!  Hopefuly my comments were helpful.

My on-line account was showing me that I have X days wait time (I am waiting for interview) and I was getting cautiously optimistic as the days went by, then the day after it said "1 day left" the message changed to "we are taking longer than expected.....", so I guess I just need to wait and wait (PD Nov 2017, NYC).

Following different threads and sites it seems like not all accounts show the same amount of information - not sure why.....

When I log in what I see is the following:

Notice that was a screenshot when it told me there is 1 day estimated wait time, followed by a screenshot of the day after.

The account also tells me how much time until case completion above the tabs (I did not take a screenshot of that part).

 

If your account shows a different layout or information I am not sure why. Some people think it depends on the type of application (IOE, NBC, etc.). In my case I filed paper but have IOE case number.

Hello All

Just have the oath ceremony today at Cadman Plaza East

Everything was smooth, I was kinda worried though since i couldn't find my expired green card (probably in my parents home, not even in new york). The uscis officer did ask him if i only have  one green card, i did not lie and told her i don't have it with me right now and she kindly told me once i found it send it back to federal plaza. 

I am amazed that many people, especially guys" wear tee, t-shirt and jeans to the ceremony. 

Since i did not bring a phone with me, i was the earliest to leave the building.

 

Anyway, after the ceremony, i went straight to the social security nearby to update my citizenship status and name change as well, it took only 10 minutes.

I have an unemployment question since I did not get any answers I  am posting here. Any help would be greatly appreciated!

 

I am filling N400 and got stuck on employment history.

How do I report the employment history due to an overlap between a part-time position and receiving unemployment insurance benefits from dept of labor?

I am doing a part-time job since July 2017. Due to the loss of my previous full-time position I received unemployment benefits from dept. of labor from Feb 1, 2017 to November 2017.

Which way do you think is correct for me to fill?

1.       July 1, 2017 to present – Part-time position

Feb 1, 2017 to June 30, 2017 – unemployed

 

Or should I fill the total time I received unemployment benefits as unemployed like the following

 

2.       July 1, 2017 to present – Part-time position

Feb 1, 2017 to November 30, 2017

 

Please let me know your suggestions!

Ok, so, strangest thing, I had my interview yesterday, and immidiately got an updated for my oath ceremony.

First of all, at my interview yesterday (7/24), I had to add two updates. One was that I got married in December, and the second was that I JUST got back from a trip outside of the country. (7/13 - 7/23, I literally got back the day before my interview).

The interview was pretty relaxed. In the beginning he did ask why I had waited so long to file for citizenship, as I have been a permanent resident since I entered the country at the age of 3 years old in 1985. I was honest and told him that after 18, I was just busy partying, then attending college, and just never got around to it. 

The questions asked were:
1: What does the presidential cabinet do?
2: We elect a senator for how many years?
3: Name a branch or part of the government.
4: What did the Declaration of Independence do?
5. If the President and Vice President are unavailable to lead, who then becomes president?
6: How many Supreme Court justices are there?

The reading question was: “The White House is located in Washington D.C.” (I think, I don’t remember too well)

Writing: “We celebrate Columbus Day in October.”

After that, we reviewed my application and he added in my recent trip and marriage. He then congratulated me and gave me a paper letting me know I passed my interview and was recommending my application for approval. 

Here’s where I am surprised: about 20 minutes after I left, I received a text message that my case was updated, I didn’t check it as I thought it was simply stating that I attended my interview. This morning (on 7/25 at 6am) I received another text stating my case was updated so I decided to log in and check. There are 3 updates all with the date of my interview (7/24).
The updates are:
1. You attended your interview
2. We have approved your application
3. Your Oath Ceremony has been scheduled. 

My Oath Ceremony is scheduled for Sept. 8th at 8:30 am. I was so surprised to see it done so fast. I was expecting to wait another 2-5 months.

Updating my case below to add Oath Date, will change the color on it after it is done.

GC-Date: The 'Resident Since' Date located on your first green card.
Sent: Date N-400 was mailed to USCIS.
Cashd: Date your check was cashed / credit card was charged by USCIS.
NOA: Receipt Notice Date Printed on your official I-797 notification.
Fprints: 
 Date assigned for fingerprinting (Bio-metrics). If you do your biometrics via walk-in prior to your scheduled appointment, please enter the date in bold blue.
In Line: Date you received e-notification about the start of your interview scheduling.
Int Ltr: Date you received the official letter in the mail regarding interview.
Interview: Date of your interview.
Oath: Date Oath taken.

Field Office: Your local USCIS office where you will have the N-400 interview.
