Hey everybody, 

 

I filed my AOS package and got the hardcopy of the NOA for my I-485 in the mail yesterday.

 

The EAD came back today with a notice that it was rejected. Reasons listed are as followed:

*forgot to sign the EAD (DUH, what a stupid mistake on my behalf!)

*filing fee incorrect or has not been provided.

 

I am pretty confused now. The instructions say that no filing fee is required for the EAD if you file an 485 as well. We sent a money order of $1.225 and my NOA for the 485 confirms that:

Application/Petition fee: $1140

Biometrics fee: $85

Total amopunt received: $1225

Total balance due: $0

 

 

 

So, am I doing something wrong or is that a mistake on their behalf?

 

Please enlighten me!

Sounds like a generic letter listing all possible reasons----no you don't need to pay for the EAD if you filed concurrently with the i-485.

 

You do need to sign it, though :P

obviously you want to sign it. 

 

Along with that I would send it back with a print out from the uscis website:

 

Note: You do not need to pay an additional fee for Form I-131 if:

  • You are filing Form I-131 Application Type B or D;
  • You filed a Form I-485 with a fee on/after July 30, 2007; and
  • Your Form I-485 is still pending.

phew, thats what i was hoping. thank you for help!

I have printed out the instruction page that is stating in what cases you dont have to pay the fee and highlighted it as well as an explanaition.

One copy of the NOA 1 should be submitted with each application because the EAD/AP goes to a different place than the AOS. It's best to send 3 rather than one.

Sign the form, attach another NOA 1 and print the instructions also and attach.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Oh! That's why your NoA was missing, makes sense lol. Mine is missing because it was overlooked. Not sure how long should I wait to file a second I765. Well, at least now you'll get for sure your i765 Noa. I wish I forgot to sign rather than being overlooked for over a month now 😂 Cheers and good hopes!! 

Timeline (From B2 visa to AOS)


July 15, 2016 -> Got married
August 3, 2017 -> Mailed AOS packet (I-130, I-485, I-765)
August 4, 2017 -> Package received
August 14, 2017 -> NOA for I-130 and I-485 (not I-765... called multiple times to ask about this but was told to wait)
August 25, 2017 -> NOA for Biometrics Appt (I-485)
August 30, 2017 -> Sent email asking to look for I-765 (My I-765 was LOST)
September 8, 2017 -> Biometrics Appt for I-485
September 26, 2017 -> Received email from USCIS I-765 found and PD August 4
October, 2017 -> NOA for I-765 and Tier 2 officer cancelled 2nd biometrics

November 3, 2017 -> Raised SR online for I-765

December 11, 2017 -> SR showed as "completed" by the assigned officer

January 8, 2018 -> Name was updated 

January 18, 2018 -> interview scheduled
