Texas will accept your first cousin marriage but remember that Texas law states that sex between first cousins is illegal. So while you can be married and live with your first cousin in Texas, having sex with each other is a felony that can send you to prison for two to ten years. 

 

It's stated in Texas penal code 25.02; Offenses Against the Family. 

 

OP, if you're set on marrying a blood relative, move to a state where all aspects of it is legal and accepted.

Because whilst immigration law is indeed chiefly federal, marriage law is state.

I'm just curious as to what difference the state would make in obtaining the CR1.

They're already married.

 

With all the back and forth in this thread I am not sure how much help the OP got lol.  What's done is done all you can do now is provide plenty of bonafide marriage evidence for interview.  OP please come back and update us on what happened.

"The CO asked her, are you first cousins and she said yes. He said, do you know in Texas first cousins aren't allowed to marry according to the state laws. You need to ask your husband to move to another state and then send us the evidence and then we can process your visa."
