Packet 3: Evidence of Relationship/Marriage Certificate/Evidence of Domicilee

It'll be a couple months at least yet, but today I looked through the information that we need to gather for packet 3 in preparation for the interview at the Montreal embassy.

 

I'm confused.  Can anyone help?

 

1) When they say they want evidence of relationship, do they mean evidence that the relationship is still ongoing since the time of filing the I129F? 

a) If so, would copies of texts suffice? The reason I ask is that since we filed on May 30, I've seen my fiance only once, for one week, back in July.  We forgot to take pictures! We also talk by Facetime but I'm not sure how to prove that Facetime calls happened or whether that would be acceptable as proof or evidence. And I'm not sure that I'll even be able to see my fiance again before the interview.

b) Just to clarify...the evidence of relationship information plus photos that we sent with the I129F does not suffice to cover their "meeting within 2-years" rule? Or is this perhaps a rule which is specific to the Montreal embassy?

 

2) They ask for a copy of the Marriage Certificate. What Marriage Certificate do they mean? I'm divorced and have already provided a copy of my divorce papers in the I129F.  Now, for packet 3, they want to see a copy of the marriage certificate from that now-divorced marriage, as well as another copy of my divorce papers?  I'm sorry if this is a dumb question, but I don't understand why they would want a marriage certificate for a defunct marriage so I just want to make sure about that.

 

3) What would constitute Evidence of Domicile for the petitioner? A copy of a bill, perhaps? Or mortgage papers?

 

Any assistance is greatly appreciated!  Thank you folks so much. :)

Hi, 

I am exactly at this step and here are my thoughts but I am not sure:

1) a) I would say they need evidence since filling the I129F. Best evidence is boarding passes that have your name. I've been saving these since we filed the I129F. I also kept the receipt for my ring engagement ring "cleaning" and some photos. b) We got an RFE that stated that photos are not sufficient... we sent passport stamps and "signed statement letter". 

2) sorry no idea about this point

3) I would say so. Driver licence or IRS document should also be sufficient... but we are wondering the same thing.

 

My question: can I submit the email with the DS-160 now that I completed it or do i have to wait to receive the packet 3 letter in the mail?!

Samples of ongoing relationship evidences collected between petition filing and visa interview. Wouldn't hurt to bring some of the other evidences that were included in the original petition.

Don't rely solely on one type of evidence. Do you have some receipts or booking confirmation emails from the visit in May? I don't use Facetime so not sure how to retrieve the logs. However, you can do some screenshots while you guys are Facetiming :) Additionally, if either of you have online ordered gifts for each other with recipient address clearly stated on the order confirmation, that's a good one too.

Ongoing relationship evidence is just that. Meeting-within-2-years evidence is different. This can generally be proven (if the following items apply to your meeting trip) by flight itinerary or other pre-booked transportation's itinerary, boarding passes, passport stamps, I-94, various booking confirmations, receipts showing you guys in the same place, photos etc.

Is the Packet 3 instructions sheet solely used for K-1 or is it for a variety of visas? If the latter, that particular document requirement is probably for someone applying for a spousal visa whereby they have to prove their marriage to their US spouse. But if the instructions clearly states that they want one for a former marriage then you should bring the original plus a copy. Usually embassies just ask for divorce decrees to ensure you're free to marry for a K-1.

Those are good. Maybe a copy of the US petitioner's state ID? Something of great importance such as a bank statement or insurance statement?

Thank you so much Lola B and KULto ATL for your kind assistance! :)

 

Due to the lengthy delays in processing that we're all experiencing, my fiance will be visiting me for another week soon. We will be sure to take photos of that visit.

 

I will also send him something as a gift by Amazon and ask him to do the same for me. That's a wonderful idea, thank you so much!! 

 

Oh, and about having the marriage certificate: I found an answer to that somewhere else (I'm sorry I forget where exactly) which is to do with whether a beneficiary ever had any other legal names than their current one. For a bride, marriage certificate may provide proof of the bride's maiden or prior name in addition to any proofs of the marriage itself, which makes sense.
