Social Security Number Concern

Hi everyone

I have questions to ask to those who can help me. I arrived with K1 visa and have been here in the US and got married already. I already have my EAD Employment Authorization ID and even the Green Card. But unfortunately my green card appeared that has mistake in my middle name. So i cannot use my green card yet because it needs to be fix first. However in my EAD Employment Authorization Document the name is right therefore i can use it right away. My question are as follows:

1. Is it possible to get social security number with the EAD Employment Authorization Document to show only? ( Can't show my Green Card because it has error in Middle name that needs to be fix)

2. I already have the Employment ID/ EAD, Do i need to get a new 1-94 if i want to get social security number? If so where can i get the new 1-94? (My old 1-94 has expired already.)

3. In which Category i already belong when i apply for Social Security Number? I am married, got EAD and the Green Card that has error..

4. In my case what are the requirements needed to show to get the Social Security Number?

I will appreciate if you can help me guys. I hope to find somebody here who can answer all my questions. Thanks a lot in advance. God bless

1. Yes, you can get an SSN with just an EAD.
2. You won't get a new I-94...they are only issued at POE.
3. I'm not sure what you mean by "Category" for an SSN. I think the option you need to use is "Legal alien allowed to work". This covers both LPRs and those with only an EAD (and even those with only the still-valid I-94 from a K-1).
4. This is where it's a little fuzzy...
   1. One option would be to schedule an InfoPass appointment to get an I-551 stamp in your passport. This would be optimal as it acts the same as a green card (for travel, work, etc.), and your social security card obtained using this as proof would be unrestricted (with only an EAD the card will state that it requires DHS authorization to work).
   2. The potential issue with just an EAD is you were granted a green card and therefore are an LPR already (even if you don't have a card yet), so I'm just not sure how you will appear in the SAVE system. But you should be fine...just bring your I-485's NOA1, EAD, passport/visa, and approval notice just in case they ask for something in particular. I wish I had a more clear answer here, but since I don't taking everything is prudent (unless somebody else has a better idea).

Since your AOS was approved, you can make an InfoPass appointment to get an I-551 stamp in your passport, which acts as a temporary green card for 1 year. That should cover you until they fix the physical green card's name. Per my post above, this would allow you to get an unrestricted SSN.

The EAD should be fine, as stated above. Many others get an SSN with the EAD alone.

The EAD is no longer valid after the Green Card is approved.

Good point...I'm not sure myself if it retained validity after approval or not. I know it becomes invalid if the case is denied...but in that case, it is actively cancelled and noted on the denial notice. I can't find anything in the policy manual, INA, or approval notice that makes a similar claim to cancel it. Do you have a source I can reference? I can't find anything definitive at all, and as such, my assumption is that the EAD retains validity until it expires. Plus, is somebody not permitted to change jobs (no proof of ability to work) between approval and green card being received?

 

Then again, they use to issue the I-551 stamps after the interview, which made all of this moot. Either way, I think the best thing is to get the stamp as it covers the OP in all circumstances until the green card issue is resolved.

Well now I'm not sure when you say that.  I know I had read somewhere that you can only have one valid immigration document at a time - but that might be just for documents that express a legal status.

Yeah, that was my thought as well. An EAD is an authorization but not a status, otherwise that would be an issue.

Yeah, can't hurt to try. And to schedule the InfoPass appointment for the stamp either way as both a backup and in case the green card takes longer to get than anticipated.
