There are other ways to increase border security than building a wall for billions of dollars and it just can't
be done along the entire border.

Who is overstaying?  I would think that an overstay references someone who went to the US legally in the first place, but stayed past the allotted time.  DACA and overstay have no common theme, from what I understand.

If the parents can't pay the penalty and repeated application fees to remain here, then adult children old enough to work pay.
If the adult children can't or won't they would have to find someone else willing to pay the fees, like a sponsor or go home.
It would be a more humane option plan rather than
having kids 'rat out their parents' in order to stay and our tax dollars don't need to be spend to raise kids without parents and traumatize these kids with demands
to rat them out in the first place. I am not claiming to have all intrinsic answers to this issue but it is not as hard as some make it out to be.
It is also an attitude problem with many who have squeezed as immigrants themselves into this country having a desire to slam the door in the face of those

who just can't cope with life and death situations in their countries and want to take them by the scruff of the neck and throw them out the door like a dirty cat.
I have faith in the majority of Americans and their congressmen to come up with a humane plan that will work.
But we must increase border security and take incentives away and heavily fine businesses who seek out the undocumented, the fraudulent application
process for cheap labor. That is a must. I believe once this is done the undocumented problem will fizzle out.
We also must find a better way to monitor overstays and get to that early on not years after the fact.
If legal immigrants who come by doing everything legal and are in total compliance with all requirements can have a home visit why can't overstays be
monitored better ?!


 

But with your plan, won't the DACA applicants (let's be clear, they are no longer kids at that point as they have to be at least 18 to apply) have to inform on the parents or adult that brought them so the penalty can be applied?  I believe when DACA was set up it purposefully said that any information provided would not be used against any other illegal alien (paraphrasing), so whether it is informing on them for deportation, or for a penalty might still be a hard choice for a young adult to make.

 

I do do agree that we need much much better enforcement of the border and on those that provide the financial enticements, but that has to come first before Congress, or the President put in place another incentive for people to take this route.  Personally, I am not holding my breath as we have already been through many cycles of immigration reform where increased border security is promised, but it never materializes then the new immigration laws take effect and we keep chasing our tail.  Congress has already passed on the Dream Act several times, so not really sure how they are going to come together now.

I think the penalty option is much easier on the young people than the chance to have their parents deported. It is the lesser of two evils.

Your definition of a criminal like any criminal the world over and mine aren't the same. The rest of your comment is also totally not of my perspective. What do you mean they don't want to work for "it". What is it ? They come to survive and work hard here. Obviously they are escaping the status quo at home.

So overstays don't bother you ? Only DACA ? I rarely read where people discuss of a way to monitor who break the law and overstay.

"It" is legal immigration.  I understand they are desperate, that is why they break the law to get out of their own version of hell.  Unfortunately, the way they choose to do so is illegal in our country.  It's a lose-lose situation, and they pick the best option for them.  But unless we are willing to forgive the millions that are already inside the US borders, and open those same borders, there isn't a good solution for them.

None of it really "bothers" me.  I have never met an illegal immigrant that I know of, nor a DACA recipient.  They have zero impact on my life, and I would imagine the same is true of the majority of people discussing it in this thread as well as other venues.  (At least here, people know what it takes to immigrate legally, as opposed to the people I see online asking why the DACA recipients haven't applied for citizenship in the past 5 years.)

So someone comes on a k1 and something happens they overstay, they should be deported as well?

Isn't that the law?  Don't we see it all the time and in part is some of the reason that K1s can be excessively scrutinized from some countries?  The question you ask is much too broad because even if this potential is due to an illness or injury to one or the other party, there are ways to get married legally to fulfill the requirements of the K1, in 90 days but if someone comes here and decided to not get married, or their USC/LPR partner dies then the law says they must leave in the 90 days.
