If everyone has to go through an FBI clearance BEFORE entering on the K-1 visa, why is it that people get stuck in "namecheck limbo" when applying for AOS?

I just think this is so strange-I mean if they are already checked-why check again?

I just had to get some opinions-sorry if this seems like a dumb question( I am having one of those weeks :wacko: )

The FBI namecheck you're referring to (that gets stuck in limbo) is done on the beneficiary which isn't performed when we file the petition initially. :blink:

I don't know the answer to why for K1s, but not everyone marries on a K1 or K3. My husband was on a tourist visa, and if they did a security check (I don't know if they do), it was 5 years ago - may as well have never had one.

The one for AOS may be more extensive as well.

But, there is the fact that not everyone comes on a fiance or spousal visa too. :)

married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

This is my opinion ! Before they approved my K1, they did a full check................then I had to provide them with my criminal history from the age of 16 and a official paper from the ministery of justice from belgium, everything was blanco..............so what are they looking for ????

They have already so many cases and then they do check up on cases that are already checked ! No wonder their process times are far behind !

It is ridiculous-I mean they check people(let's say coming in on a K-1), then they hold people up again to check the person out again???? :blink::blink:

I know the process is severely flawed, I was just wondering why they have to do things all over again?

just wanted to hear what you guys had to say-I am not ranting "YET", I just had to ask :whistle:

They do so many checks, I know that checking is ofcurse needed but sometimes,its frustrating!

I think the medical system for K1 and K3 visas is severely flawed.

K-1 visa issued: 12/15/2006

107 days from mailing AOS package to receiving green card! Received 6/27/07 dated 6/20/07

Removing conditions:

mailed 5/22/2009

Recieved at CSC 5/23/2009

Check cashed 5/27/09

NOA date 5/26/09 - still not received

I-551 stamp in passport 6/19/09

Biometrics notice date 6/16/09

Biometrics received 6/20/09

Biometrics apt date 7/9/09

Biometrics cancellation notice 6/27/09

Biometrics apt notice date 6/26 recieved 7/7

Biometrics apt 7/22/09

Touch 7/22/09

Finally able to see online info 7/22/09

Card production email 8/19/09 date ordered 8/18

Recieved approval letter in mail 8/19/09 date 8/13!

Touch 8/19

Email stating approval notice sent 8/24/09

Green card in hand!! 8/24/09

Husband joined army and moved from San Diego to Ft. Benning GA! 8/30/11

Filed N400 based on 5 years of residency 9/12/12

Recieved email notifcation recieved package 9/19/12

Biometrics 10/22/12

Early Biometrics 10/04/12

In line for interview 10/8/12 for 8 days

Interview 11/20/12 PASSED!

doing the FBI namecheck isnt "doing the whole process from overseas again". For a visa, most places, police reports are sufficient (where as lucky us, get AR - security clearances) all this is DOS requirements. FBI namecheck stateside is for DHS. Different procedure. Many parts may parallel, but its not that same thing.

my husband & I have both been bad lately :devil:

we had to wait through the FBI check for the K-1 because my man had 2 drunk & disorderly convictions. I just think all these people waiting for a year or so(like Rebecca's-Wes) is ridiculous.

Once he came back clear it only took 2 weeks to get back to the embassy in Dublin. I am just aying that it is ridiculous to do it all again when it was just done a few months ago.

And why do some people wait years????

No one thinks the year long waits are "fair" - but it is what it is, and not much can speed up a name check - just ask rebeccajo. If I recall, even her senator, etc. couldn't get anything other than "namecheck still spending".

Maybe there have been hits on his name that they have to research. No one here has rock solid answers for you.
