According to USCIS: EAD Cat 09 is being processed as of 9/15.

According to VJ: EAD is being processed as of 8/28. I don't think VJ has the stats for Cat 9?

Which one is correct?

I am EAD Cat 9. Does this mean I should get it earlier than what VJ says?

Your lawyer is silly....The I94 has nothing to do with this process...The travel visa allows you to leave the US without stopping your GC process, without it you are not allowed to leave the US and if you do, it suspends the process and you will not be allowed back. You will need to make a request for Green Card based on marriage, which is a whole new process and is  very long as well...

It's no big deal if you plan to stay, but at the same time it wouldn't have hurt to have it in my opinion.

Also USA isn't welcoming when it's come to my country so I really don't take any risk going out of USA even with advance parole so I ll wait for my green card and I m not in a rush.

That is unfortunatey unlikely.  It varies from state to state - and we are about 48th in terms of processing times - it takes up to (and sometimes longer than) a year at the St Paul office.  It is one of the slowest in the country.

You will have your interview before you get your green card.  If your office is St Paul it is VERY unlikely that you will hear anything about your interview for several months.  St Paul used to transfer about half of their i485 cases for processing without interview - but I understand that under the current administration this is happening less and less.  USCIS and visajourney statistics show that St Paul takes about a year to process i485s.  You should be completely safe to travel to China for your wedding in January.  If you receive a notification before then (which is unlikely) you can call and reschedule.

Have a great trip!  Do update if you hear anything about interview!  I would love to hear that St Paul is doing better and we have our green cards in the Spring next year and not the fall!   I have friends who got their EAD about six weeks ago (filed in June) and their status updated to 'ready to schedule interview' about a month ago and no further news yet - I think you will be fine to travel in January.  You have plenty of time before you'll need to worry about the interview :)

After reading some September filers already starting to receive EAD or combo cards, that made me really nervous because I haven't receive yet. It been 83 days since they received Sept 13. I got 1 RFIE on October 26 for form I-485 and I already mailed it back few days after. Will that cause delay process?

Unfortunately I do think an RFIE could cause some delays. It is assumed that USCIS pauses the processing of the EAD/AP petitions when there is an RFIE for the I-485, and processing is then resumed once the requested documents are received.

We also got an RFIE, and they received our additional evidence response on October 18. Here's to hoping that we both get our EAD/AP approval letter soon.

Hi @PR&PR,

Thanks, I agree it's confusing by the names USCIS uses. Truly the list I mentioned was about a type of service request to Expedite, as you very well noticed.

As for the other types of service requests (there are several), this may be helpful: https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume1-PartA-Chapter8.html

For those of you interested in the "Approaching Regulatory Timeframe" look at this:

Good luck!

Hi @bbf3562

If you read the information above, it seems that USCIS stops the clock for EAD/AP when they send an RFE. On the bright side, I do not remember who it is, but at least one of the people who received their EAD in this thread had an RFE. Hope!

We got an RFE and we have not received the EAD even if I filed for an expedite based on an employment offer. That being said: I did receive the interview date, so I-485 has moved forward, AND it is unclear to me if what is "delaying" the EAD is the RFE or the expedite
